Article 15-1. Conditions and limits of the use of physical force, special means, weapons and military equipment of the Law on National Security Agencies of the Republic of Kazakhstan
1. Employees and military personnel of national security agencies have the right to carry, store and use weapons, military equipment and special means, as well as physical force.
2. They are required to undergo special training and periodic checks on their suitability for action in conditions involving the use of physical force, special means and weapons.
3. In cases of necessary defense and extreme necessity, or when detaining a person who has committed a criminal offense, an employee or serviceman of the national security agencies, in the absence of the necessary special means or weapons, has the right to use any improvised means, as well as, on the grounds and in accordance with the procedure established by this Law, to use other weapons that are not in service.
4. An employee and a serviceman of the national security agencies shall not be liable for moral, material and physical harm caused in connection with the use of physical force, special means, weapons and military equipment in cases provided for by law, if the protection corresponds to the nature and danger of encroachment on protected persons, other citizens, protected objects or the employee or serviceman himself national security agencies.
5. The use of physical force, special means, weapons and military equipment by employees and military personnel of national security agencies in excess of their authority entails liability established by law.
6. In the area of the anti-terrorist operation, employees and military personnel of national security agencies participating in the anti-terrorist operation have the right to use physical force, military and other equipment, weapons and special means, including service animals, against terrorists, without warnings and restrictions provided for by this Law and other laws of the Republic of Kazakhstan.
This Law defines the status, powers and organization of activities of the national security bodies of the Republic of Kazakhstan.
