1. Materials obtained in the course of operational investigative activities may be used for the preparation and implementation of investigative actions and operational investigative measures to prevent and suppress criminal offenses, as well as in the process of proving criminal cases, provided they are verified in accordance with the provisions of the criminal procedure legislation of the Republic of Kazakhstan regulating the collection, research and evaluation of evidence.

The materials of operational investigative activities may be used in the performance of other tasks provided for in Article 2 of this Law, after their verification in accordance with the procedure established by the legislation of the Republic of Kazakhstan, with the exception of the results obtained in the course of intelligence activities, for which the procedure for their use is established by departmental regulatory legal acts.

2. Materials obtained as a result of operational search measures, before they are put into the form provided for by the criminal procedure legislation of the Republic of Kazakhstan, or if it is not possible to introduce them into the criminal process, are not grounds for restricting the rights, freedoms and legitimate interests of individuals and legal entities, as well as for initiating disciplinary proceedings against judges.

3. Information on the organization of operational search activities, on specific operational search activities, sources and methods of obtaining information constituting a state or other legally protected secret, with the exception of cases provided for by the legislation of the Republic of Kazakhstan, as well as information affecting the personal life, honor and dignity of a person and citizen, are not subject to disclosure.

4. Persons to whom they have become known as a result of the performance of professional duties are responsible for the disclosure of information about operational investigative activities in accordance with the laws of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated September 15, 1994 No. 154-XIII.

This Law defines the content of operational investigative activities carried out on the territory of the Republic of Kazakhstan and establishes a system of legal guarantees of legality in its conduct.
