1. In order to ensure the safety of the public, prevent harm to the environment and create conditions for the safe operation of the main pipeline along its route, regardless of the type of laying, as well as around the main pipeline facilities, security zones are established, marked locally with special signs in accordance with the requirements of the technical regulations on the safety of the main pipeline.

When several main pipelines are located in one technical corridor, a single security zone is established for all main pipelines.

2. Security zones of the main pipeline are established:

1) along the routes of the main pipeline transporting oil, petroleum products, natural gas, petroleum and artificial hydrocarbon gases – in the form of a land plot limited by conventional lines passing fifty meters from the axis of the pipeline on each side; on agricultural lands, the protection zone of the main pipeline is limited by conventional lines passing twenty-five meters from pipeline axes on each side;

2) along the routes of the main pipeline transporting liquefied petroleum gases, unstable gasoline and condensate, in the form of a land plot bounded by conventional lines passing one hundred meters from the axis of the pipeline on each side.;

3) along the routes of multi-threaded pipelines laid in one technical corridor – in the form of a land plot limited by conventional lines extending from the axes of the extreme pipelines at the distances provided for in subparagraphs 1) and 2) of this paragraph, depending on the type of transported products.;

4) along underwater crossings – in the form of a section of water space from the water surface to the bottom, enclosed between parallel planes separated from the axes of the extreme threads of the crossings by one hundred meters on each side;

5) around condensate storage and degassing tanks, earthen barns for emergency production – in the form of a plot of land bounded by a closed line fifty meters away from the boundaries of the territories of the specified facilities in all directions;

6) around technological installations for preparing products for transportation, head and intermediate pumping and bulk pumping stations, tank farms, compressor and gas distribution stations, product measurement units, filling and discharge ramps, underground gas storage stations, oil heating points, petroleum products – in the form of a land plot bounded by a closed line located from the borders of territories the specified objects are one hundred meters in all directions.

3. The protection zones of the main pipeline include: protective forest zones, land plots necessary to ensure the safety, strength and stability of structures, devices and other facilities, service roads, as well as land plots adjacent to the branch line of the main pipeline located in mudslide, landslide-prone areas and places subject to other dangerous influences.

4. The lands within the protection zones of the main pipelines have a special land use regime and are not withdrawn from the owners of land plots and land users.

5. It is prohibited in the security zone of the main pipeline:

1) construction of crossings, dirt roads and other temporary or permanent transport intersections of the main pipeline route and its security zone without coordination with the owner of the main pipeline, their location, the order of construction, arrangement and use;

2) gardening and afforestation, as well as performing any work not coordinated with the owner of the main pipeline, except for a complex of agrotechnical works for growing field crops with an arable depth of no more than thirty-five centimeters;

3) reclamation of roads equipped by the owner of the main pipeline or the operator, intended for maintenance of the main pipeline and ensuring its physical protection, as well as obstruction of the movement of workers performing fire and security functions on the main pipeline along these roads, except in cases established by the legislation of the Republic of Kazakhstan;

4) the construction of any buildings and structures;

5) organization of parking lots for motor vehicles, tractors and machinery;

6) production of reclamation earthworks, construction of irrigation and drainage systems;

7) mining, construction, installation and blasting operations, ground planning without coordination with the owner of the main pipeline;

8) production of geological survey, prospecting, geodetic and other survey work related to the construction of wells, pits and soil sampling (except for soil samples).

6. It is not allowed to impose the obligation to acquire ownership or use of land and water plots within the boundaries of the protection zone of the main pipeline on the owner of the main pipeline or the operator.

7. The operator within the protection zones of the main pipeline has the right to carry out work on the repair and maintenance of the main pipeline, as well as work on the prevention of emergency situations with prior notification to the owners of the land (land users) and subsequent compensation for the damage caused to them, and in case of emergency – without prior notification with subsequent compensation for the damage.

8. In order to ensure safety, it is prohibited to build any facilities that are not related to the main pipeline, within the minimum distances established by building codes and regulations.

This Law regulates public relations arising during the design, construction, operation, conservation and liquidation of the main pipeline, and is aimed at ensuring efficient, reliable and safe operation of the main pipeline.
