1. Planning for the development of highways is carried out by government agencies managing commercial and private highways in accordance with approved national and regional programs. Planning for the development of the road network of settlements is carried out by the relevant local executive authorities with mandatory allocation of land for the organization of parking lots and parking facilities for vehicles, as well as for the construction of fiber-optic communication lines along highways.

2. Public procurement of scientific research in the road industry is carried out in accordance with the legislation of the Republic of Kazakhstan on public procurement.

3. The design and construction of highways are carried out by individuals and legal entities licensed to carry out the relevant types of activities on a competitive basis.

4. Feasibility studies and design estimates developed for the construction of new or reconstruction and overhaul of existing highways are subject to a comprehensive non-departmental expert examination of construction projects carried out in accordance with the procedure established by the legislation of the Republic of Kazakhstan. According to the technical documentation intended for the average repair of highways, a departmental examination is carried out in accordance with the procedure determined by the authorized state body for highways.

5. When planning the development, reconstruction and repair of public roads, in coordination with the authorized state body for highways, it is possible to build fiber-optic communication lines with their further transfer to the maintenance of the authorized body in the field of communications.

This Law regulates the legal, organizational and economic foundations of the state management of highways in the Republic of Kazakhstan, their construction, operation and development in the interests of the state and users of highways.
