Article 14-6. State registration of pesticides of the Law on Plant Protection
1. The state registration of pesticides is carried out based on the results of registration (small-scale and production) tests in accordance with the rules for registration (small-scale and production) tests and state registration of pesticides.
The grounds for a reasoned refusal of state registration of pesticides are:
1) inconsistency of the chemical composition, formulation and technology of production (formulation) of pesticides declared for registration (small-scale and production) tests with the chemical composition, formulation and technology of production (formulation) of pesticides submitted for state registration of pesticides;
2) violation of the rights of patent holders for inventions related to pesticides;
3) other grounds provided for by the laws of the Republic of Kazakhstan "On Public Services", "On permits and notifications".
Pesticides that have passed state registration are allowed for production (formulation), import, storage, transportation, sale, use and are included in the list of pesticides by the authorized body.
In accordance with the rules of registration (small-scale and industrial) tests and state registration of pesticides, temporary registration of pesticides for a period of no more than two years is allowed for:
1) control of certain harmful and especially dangerous harmful organisms, as well as quarantine facilities identified for the first time on the territory of the Republic of Kazakhstan, the spread of which can lead to significant harm to plants and plant products, deterioration of the phytosanitary situation, if there are no pesticides of the necessary purpose.;
2) Low-risk biological drugs.
During the period of temporary registration of a biological preparation, registration (small-scale and production) tests must be carried out with further submission by the registrant (applicant) of the documents required for its state registration.
2. Withdrawal (revocation) of the registration certificate for a pesticide is carried out in the following cases::
1) obtaining previously unknown information about the danger of a pesticide to human health or the environment, confirmed by the authorized body in the field of environmental protection and the state body in the field of sanitary and epidemiological welfare of the population;
2) inclusion of the pesticide in the list of plant protection products prohibited for import into the customs territory of the Eurasian Economic Union, subject to Annexes A and B of the Stockholm Convention on Persistent Organic Pollutants of May 22, 2001;
3) confirmation of the lack of biological efficacy of the registered pesticide used based on the results obtained following the results of phytosanitary measures.
3. The suspension of the registration certificate for a pesticide is carried out based on the results of state phytosanitary control, which revealed the fact that the chemical composition and amount of the active substance of the registered pesticide used do not match the chemical composition and amount of the active substance stated in the registration dossier during its state registration.
Upon establishing the fact that the chemical composition and amount of the active substance of the registered pesticide used do not correspond to the chemical composition and amount of the active substance stated in the registration dossier during its state registration, the department of the authorized body decides to suspend the validity of the registration certificate for the pesticide for a period of twelve months.
The renewal of the registration certificate is carried out in accordance with the procedure established by the legislation of the Republic of Kazakhstan on permits and notifications.
4. The production (formulation), import, storage, transportation, sale and use of pesticides that have not passed state registration, as well as the initial components for the production (formulation) of unregistered pesticides, with the exception of prototypes, are prohibited., imported for registration (small-scale and industrial) tests and (or) scientific research based on the conclusion (authorization document) for the import of samples of unregistered plant protection products (pesticides) for registration (small-scale and industrial) tests and (or) scientific research in accordance with the decisions of the Board of the Eurasian Economic Commission. The amount of pesticides imported for registration (small-scale and industrial) tests and (or) scientific research is determined by the authorized body.
The grounds for a reasoned refusal to import unregistered pesticide samples intended for registration (small-scale and industrial) tests and (or) scientific research are the absence of unregistered pesticides in plans for registration (small-scale and industrial) tests of pesticides, the absence of a contract for scientific research, as well as other grounds provided for by the legislation of the Republic of Kazakhstan.
The Law of the Republic of Kazakhstan dated July 3, 2002 No. 331.
This Law defines the legal, economic and organizational bases for carrying out activities in the field of plant protection from pests, weeds and plant diseases and is aimed at preserving crops, their quality and preventing harmful effects on human health and the environment when implementing phytosanitary measures in the territory of the Republic of Kazakhstan.
