Employees and military personnel of the State Security Service of the Republic of Kazakhstan have the right to use weapons and military equipment as a last resort in the following cases::

1) to repel attacks on protected persons;

2) to repel attacks on buildings, structures, premises and other objects and vehicles protected by the State Security Service of the Republic of Kazakhstan;

3) to repel attacks on employees, military personnel of the State Security Service of the Republic of Kazakhstan, their family members, as well as other persons involved by this body in ensuring security measures;

4) to protect citizens from criminal encroachment, as well as the release of hostages, seized protected facilities, structures and special cargo;

5) to detain persons caught in the commission of a criminal offense, or immediately after the commission, who are offering armed resistance, as well as an armed person who refuses to comply with a legal requirement to surrender weapons.;

6) to prevent violations of airspace by unmanned aircraft in the area of security measures or over the territory of protected facilities.

Employees of the State Security Service of the Republic of Kazakhstan have the right, in addition, to use weapons in the following cases::

1) to stop a vehicle if the driver poses a real danger to the life and health of protected persons and refuses to stop at the request of an employee, a serviceman of the State Security Service of the Republic of Kazakhstan;

2) to protect against animal attacks;

3) To sound an alarm or call for help.

It is prohibited to use weapons against protected persons, as well as against women and minors, except in cases where they commit an armed attack, provide armed resistance, take hostages, aircraft, as well as in cases where the use of weapons may endanger the life and health of others.

In all cases of the use of weapons, employees and military personnel of the State Security Service of the Republic of Kazakhstan are required to take the necessary measures to ensure the safety of surrounding citizens and provide emergency medical care to victims.

The prosecutor is informed within twenty-four hours about each case of the use of physical force, special means, weapons and military equipment that has resulted in the death of people or other grave consequences.
