Article 13-1. The rights and obligations of an employee holding the position of a security guard in a private security organization of the Law on Security Activities

     1. The rights and obligations of an employee holding the position of a security guard in a private security organization are determined in accordance with the Labor Code of the Republic of Kazakhstan, the employment contract and this Law.

     2. An employee holding the position of a security guard in a private security organization has the right:

     1) to assist the internal affairs bodies of the Republic of Kazakhstan in carrying out measures to ensure public order, including during spectacular cultural and sports events;

     2) to prevent and suppress criminal and administrative offenses;

     3) to use physical force and other means for the purpose of suppressing offenses and detaining offenders, if it is not possible to achieve these goals by other means. At the same time, the necessary measures should not be exceeded.;

     4) in cases stipulated by laws, detain and bring to the law enforcement agencies of the Republic of Kazakhstan persons who have committed a criminal or administrative offense. If necessary, when there is reason to believe that the detained person has weapons, as well as other dangerous and (or) prohibited items, in accordance with the legislation of the Republic of Kazakhstan, inspect the detainee's clothes and seize these items for transfer to the law enforcement agencies of the Republic of Kazakhstan or another government authority.;

     5) to assist in the provision of medical and other assistance to individuals affected by unlawful encroachments, road accidents, natural disasters and other emergency situations;

     6) require individuals to observe public order.

     3. An employee holding the position of a security guard in a private security organization must:

     1) to respect the constitutional rights and freedoms of citizens;

     2) immediately inform the internal affairs bodies of the Republic of Kazakhstan about the facts of upcoming or committed offenses that have become known to them.;

     3) immediately inform the internal affairs bodies of the Republic of Kazakhstan about the triggering of a security alarm from protected facilities in the territory of which there are weapons, ammunition and explosives;

     4) in cases provided for by law, to present, at the request of individuals, a certificate confirming its affiliation to the subject of security activities;

     5) to provide assistance to the subjects of crime prevention;

     6) explain to individuals detained for committing a criminal or administrative offense the grounds for the coercive measures applied to them.

 

 

The Law of the Republic of Kazakhstan dated October 19, 2000 No. 85.

      This Law establishes the legal basis of security activities in the territory of the Republic of Kazakhstan, defines the status and powers of subjects engaged in security and security activities.
