1. Flora and plant habitats are subject to protection.

2. The protection of flora and plant habitats is ensured by:

1) prevention and suppression of damage or destruction of plant species, their populations and communities;

2) reserving land plots where it is planned to create or expand specially protected natural territories with restrictions on economic activities within these areas that negatively affect the state of the flora;

3) preservation of the gene pool of valuable plant species in areas of their natural growth, in botanical collections, as well as the genetic material of these species in collections of plant genetic resources;

4) organization of scientific research (work) in the field of protection, restoration, and use of flora;

5) the establishment of restrictions (suspension) of the right to use wild plants;

6) bringing to responsibility individuals and legal entities for violating the legislation of the Republic of Kazakhstan in the field of protection, restoration and use of flora;

7) promoting the conservation of flora and the formation of ecological culture in society;

8) adoption of other state regulatory measures.

3. The protection of flora and plant habitats is carried out by local executive bodies, except in cases when the protection of flora and plant habitats is entrusted to the owners of land plots, land users and water users, users of flora in accordance with the legislation of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated January 2, 2023 No. 183-VII SAM.

This Law regulates public relations and establishes the legal basis of state policy in the field of protection, restoration, and use of flora.
