Article 12. Authorized body The Law on Civil Protection
1. The authorized body exercises the following powers:
1) performs strategic, regulatory, implementation, and supervisory functions within its competence;
2) on the basis of and in pursuance of the main directions of the internal and foreign policy of the state, defined by the President of the Republic of Kazakhstan, and the main directions of the socio-economic policy of the state, its defense capability, security, and public order, developed by the Government of the Republic of Kazakhstan, forms a state policy in the field of civil protection in accordance with the legislation of the Republic of Kazakhstan;
3) directs the civil protection forces in the organization and conduct of civil protection activities;
4) adopt, within its competence, decisions on the preparation and conduct of civil defense, mandatory for execution by state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, central and local executive bodies, organizations and citizens;
5) develops and approves the nomenclature and volume of material assets of the operational reserve of the authorized body;
6) develops and approves the rules for the operation, movement, use, replenishment of material assets of the operational reserve of the authorized body;
7) ensures the combat and mobilization readiness of the territorial bodies of the authorized body, military units of civil defense;
8) carries out the recruitment of employees and military personnel of civil protection bodies, transfer of service, dismissal from service, resolution of issues of awarding military and special ranks within its competence;
9) awards departmental awards and submits a submission to the President of the Republic of Kazakhstan for awarding state awards;
10) ensures that the public and civil protection management bodies are informed and notified in advance if there is a forecast of the threat of an emergency and (or) promptly in case of an emergency.;
11) develops and approves rules for the use of communications, transport, property and other material assets of organizations located in emergency zones for the rescue of people in case of emergency.;
12) carries out emergency rescue and emergency work;
13) carries out international cooperation in the field of civil protection;
14) purchases petroleum products from a single operator for the supply of petroleum products, determined by the authorized body for state regulation of the production of petroleum products;
15) carries out an inquiry in cases of criminal offenses related to fires, within the limits of its powers;
16) carries out state control and supervision in the field of fire safety;
17) defines a list of requirements, the violation of which entails the use of rapid response measures, and also defines, in relation to specific violations of the requirements, a specific type of rapid response measure, indicating the duration of this measure (if necessary).
The list of requirements, the violation of which entails the use of rapid response measures, includes requirements that are subject to state control in accordance with Article 143 of the Entrepreneurial Code of the Republic of Kazakhstan.;
18) carries out state control in the field of civil defense;
19) organizes scientific research, promotion of knowledge, training of the population and specialists in the field of civil protection;
20) monitors the readiness of fire departments in populated areas and facilities to fight fires;
21) defines the structure of civil defense plans and contingency plans;
22) develops plans for the civil defense of regions, cities, and districts;
23) develops action plans for the elimination of global and regional emergencies and submits them to the Government of the Republic of Kazakhstan for approval;
24) develops and approves an action plan for the training of government bodies and civil protection forces;
25) develops and approves instructions for determining the need for civil protection equipment;
26) develops and approves rules for the storage, accounting, write-off and disposal of civil defense property;
27) develops and approves the rules for registration and de-registration of civil defense protective structures;
28) develops and approves qualification requirements for specialized training centers in the field of fire safety for the training, retraining and advanced training of specialists in professional fire services;
29) develops and approves a program of training courses for the special training of specialists in professional fire services, as well as a sample certificate of their completion;
30) develops and approves a list of organizations and facilities where a professional fire service is mandatory.;
31) develops and approves instructions on the content and scope of civil defense engineering measures;
32) develops and approves the curriculum for the initial training of volunteer firefighters;
33) develops and approves a training program for managers, specialists of government bodies and civil protection forces, training the population in ways of protection and actions in case of emergencies and military conflicts or as a result of these conflicts;
34) develops and approves regulations on republican civil protection services;
35) develops and approves rules for training employees of organizations and the public in fire safety measures and requirements for the content of training programs on fire safety measures;
36) decides on the release of material assets from the state reserve in order to take measures to prevent and eliminate emergencies and their consequences in the order of disbandment;
37) ensures the activities of the civil protection forces;
38) submits proposals to the Government of the Republic of Kazakhstan on the use of the reserves of material, technical, food, medical and other resources available in the state and mobilization reserves, on the use of funds from the reserve of the Government of the Republic of Kazakhstan for the prevention and elimination of emergency situations and their consequences;
39) uses Earth remote sensing data to prevent and eliminate natural and man-made emergencies and assess their consequences;
40) participates in the development and coordination of an environmental sensitivity map with sensitivity indices for the elimination of oil spills at sea and in the protective zone of the Republic of Kazakhstan in accordance with the procedure determined by the authorized body in the field of environmental protection;
41) mobilizes the material and technical resources of organizations in accordance with the legislation of the Republic of Kazakhstan during the liquidation of emergency situations.;
42) carries out certification of professional fire fighting services for the right to carry out work on fire prevention and extinguishing, fire safety and rescue operations related to fire fighting in organizations, settlements and facilities;
43) maintains state records of natural and man-made emergencies;
44) provides protection from fires of territories of settlements and especially important objects of state property;
45) provides for the creation of spare (suburban) and mobile control points for the head of the Civil Defense of the Republic of Kazakhstan and central executive bodies;
46) develops and approves standards of minimum life support for the population in the emergency zone;
47) allocates, on the basis of instructions from the Prime Minister of the Republic of Kazakhstan, funds from the reserve of the Government of the Republic of Kazakhstan for the life support of the population in the elimination of natural and man-made emergencies in accordance with the procedure determined by the Government of the Republic of Kazakhstan.;
48) develops and approves the rules for the organization and operation of the state civil protection system;
49) develops and approves the rules for the organization of the civil protection notification system and public notification, management bodies in emergency situations in peacetime and wartime;
50) develops and approves rules for the acquisition and use of civil defense property;
51) develops and approves safety regulations for water bodies;
52) develops and approves the rules for the implementation of professional fire services;
53) develops and approves rules for the creation, maintenance, logistical support, training and involvement of civil protection units;
54) develops and approves rules for the implementation of state accounting of natural and man-made emergencies;
55) develops and approves rules for the organization and conduct of civil defense activities;
56) develops and approves rules for the transfer of civil protection from peaceful to martial law;
57) develops and approves the rules for the use of military units of civil defense in peacetime;
58) develops and approves rules for calculating the length of service for rescuers of professional emergency services and formations for the payment of interest allowances for years of service;
59) develops and approves rules for the payment of class allowances to rescuers of emergency services and formations;
60) develops and approves rules for informing, promoting knowledge, and educating the public and specialists in the field of civil protection;
61) develops and approves rules for the investigation of accidents, disasters, and disasters that have led to emergencies;
62) develops and approves the licensing requirements for professional fire services;

64) develops and approves rules for extinguishing steppe fires, as well as fires in populated areas where there are no units of the state fire service;
65) develops and approves standards for the number of employees of civil protection agencies;
66) carries out the accreditation of expert organizations;
67) develops and approves the licensing requirements for expert organizations;
68) develops and approves the rules for the accreditation of expert organizations;
69) develops and approves the rules for conducting an audit in the field of fire safety;
70) maintains the state register of expert organizations;
71) develops and approves the rules for carrying out the activities of research testing fire laboratories;
72) develops and approves rules for the organization of fire extinguishing;
73) develops and approves the Statute of the fire service;
74) ensures the maintenance of the authorized body's operational reserve;
75) develops and approves the rules for the certification of professional fire fighting services for the right to carry out work on fire prevention and extinguishing, fire safety and emergency rescue operations related to extinguishing fires in organizations, settlements and facilities;
76) develops and approves fire safety regulations;
77) develops and approves rules for the medical and psychological rehabilitation of employees, military personnel and employees of civil protection agencies on the basis of medical institutions and rehabilitation centers;
78) develops and approves the form of the act on suspension of activities or certain types of activities in the field of fire safety;
79) uses technical means in the implementation of state control and supervision in the field of fire safety to record the facts of violations and actions of employees of civil protection bodies;
80) develops and approves rules for the organization and conduct of evacuation measures in peacetime;
81) allocates and uses the material assets of the operational reserve of the authorized body;
82) coordinates the activities of the maritime organization of the authorized body;
83) if a single operator for the supply of petroleum products refuses to purchase petroleum products using the card system, it independently purchases petroleum products on a competitive basis at the expense of budgetary funds for the corresponding year.;
84) develops a civil defense plan of the Republic of Kazakhstan, which is an integral part of the defense plan of the Republic of Kazakhstan, and submits it to the Ministry of Defense of the Republic of Kazakhstan;
85) ensures the development of dog training services in civil protection agencies;
86) uses technical means in the implementation of state control in the field of civil defense to record the facts of violations and actions of state inspectors for state control in the field of civil defense;
87) develops and approves a list of facilities with a mass stay of people with an area of more than two thousand square meters subject to fire safety insurance, as well as a standard contract for imputed civil liability insurance of owners of facilities with a mass stay of people for causing harm to life, health and property of third parties in coordination with the authorized regulatory body; control and supervision of the financial market and financial organizations;

93) develops and approves rules for the payment of salaries, allowances and other payments to employees of civil protection agencies;
94) ensures the implementation of a unified state personnel policy in civil protection bodies;
95) organizes training, advanced training and retraining of personnel for civil protection agencies;
96) develops and approves rules for determining the class qualifications of employees and military personnel of civil protection agencies;
97) ensures the protection of information constituting state secrets and uninterrupted encrypted communication in peacetime and wartime;
98) develops and approves rules for the organization and conduct of evacuation measures in wartime;

101) develops and approves the rules for conducting seismological monitoring;
102) develops and approves regulatory legal acts in the field of civil protection in accordance with the objectives of this Law and the legislation of the Republic of Kazakhstan;
103) exercises other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.
2. The authorized body has a banner and a symbol. Its territorial bodies and educational organizations have banners, military units of civil defense have battle flags, and the emergency medical and psychological assistance service has a symbol.
