The authorized body in the field of industrial safety exercises the following powers:

1) excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective ten calendar days after the date of its first official publication).

1-1) performs strategic, regulatory, implementation, and supervisory functions within its competence.;

1-2) on the basis of and in pursuance of the main directions of the internal and foreign policy of the state, defined by the President of the Republic of Kazakhstan, and the main directions of the socio-economic policy of the state, its defense capability, security, and public order, developed by the Government of the Republic of Kazakhstan, forms the state policy in the field of industrial safety in accordance with the legislation of the Republic of Kazakhstan;

2) carries out state control and supervision in the field of industrial safety;

IZPI's note! Subparagraph 2-1) is provided for in the wording of the Law of the Republic of Kazakhstan dated 06/24/2025 No. 196-VIII (effective from 01.01.2026).

2-1) defines a list of requirements, the violation of which entails the use of rapid response measures, and also defines, in relation to specific violations of the requirements, a specific type of rapid response measure, indicating the duration of this measure (if necessary).

The list of requirements, the violation of which entails the use of rapid response measures, includes requirements that are subject to state control, in accordance with Article 143 of the Entrepreneurial Code of the Republic of Kazakhstan.;

3) excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective ten calendar days after the date of its first official publication). 4) excluded by the Law of the Republic of Kazakhstan dated December 29, 2014 No. 269-V (effective from 01.01.2015);

5) organizes and conducts accident investigations jointly with interested government agencies within their competence;

5-1) organizes and conducts a technical investigation of cases of loss of explosives and products based on them together with interested government agencies within their competence;

6) carries out the certification of legal entities for the right to carry out work in the field of industrial safety;

6-1) carries out the certification of professional emergency services in the field of industrial safety;

7) issues a permit for the use of technologies used at hazardous production facilities, hazardous technical devices;

8) issues a permit for the permanent use of explosives and products based on them, the production of explosive work;

8-1) issues a license to carry out activities related to the development, production, acquisition, sale, and storage of explosive and pyrotechnic (except for civilian) substances and products with their use;

8-2) is excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective ten calendar days after the date of its first official publication). 9) excluded by the Law of the Republic of Kazakhstan dated 06/24/2025 No. 196-VIII (effective ten calendar days after the date of its first official publication). It is envisaged to supplement Article 12-2 with sub-paragraphs 9-1), 9-2) in accordance with the Law of the Republic of Kazakhstan dated 06/24/2025 No. 196-VIII (effective from 01.01.2026).

9-3) develops and approves regulatory legal acts in the field of industrial safety in accordance with the objectives of this Law and the legislation of the Republic of Kazakhstan;

10) excluded by the Law of the Republic of Kazakhstan dated 04/01/2021 No. 26-VII (effective after ten calendar days after the date of its first official publication); 11)-20) excluded by the Law of the Republic of Kazakhstan dated 04/19/2023 No. 223-VII (effective after ten calendar days after the date of its first official publication).

21) exercise other powers provided for by this Law, other laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan.

This Law regulates public relations arising in the process of carrying out civil protection measures and is aimed at preventing and eliminating natural and man-made emergencies and their consequences, providing emergency medical and psychological assistance to the population in the emergency zone, ensuring fire and industrial safety, and also defines the main tasks and organizational principles of building and the functioning of the civil defense of the Republic of Kazakhstan, the formation of, storage and use of the state material reserve, organization and activities of emergency services and formations.
