Article 11. Scientific organizations The Law on Science and Technology Policy
1. A scientific organization is a legal entity whose main activities are the implementation of scientific and (or) scientific and technical activities, including the realization of intellectual property rights, as well as conducting scientific research.
Consultative and advisory bodies may be established at a scientific organization.
2. State scientific organizations are scientific organizations based on the right of state ownership, including in the organizational and legal form of state institutions.
State institutions in the field of science have the right to provide services that meet their statutory goals and use the money from the sale of such services in accordance with the procedure determined by the authorized body, in accordance with the budget legislation of the Republic of Kazakhstan.
Equivalent to state scientific organizations are scientific organizations, fifty or more percent of the voting shares (participation shares in the authorized capital) of which belong to the state, as well as scientific organizations in which fifty or more percent of the voting shares (participation shares in the authorized capital) are directly or indirectly owned by legal entities, fifty or more percent of the voting shares (shares of participation in the authorized capital) which belong to the state. Indirect affiliation means that each subsequent person owns fifty percent or more of the voting shares (stakes in the authorized capital) of another legal entity.
3. The only higher scientific organization is the National Academy of Sciences of the Republic of Kazakhstan.
The National Academy of Sciences of the Republic of Kazakhstan carries out its activities in order to ensure the continuity of fundamental and (or) applied scientific research conducted in the most important areas of science.
Academies established as a legal entity without government involvement are prohibited from using the word "national" in its full or abbreviated form in any language.
4. Academies operating in the field of scientific and (or) scientific and technical activities, creative unions of scientists, which are public associations, participate in the implementation of scientific and (or) scientific and technical policy, the development of priority areas for the development of science, scientific and technical expertise of scientific research and works nominated for scientific prizes., They make proposals for the development of draft regulatory legal acts in the field of scientific and (or) scientific and technical activities and professional consolidation of scientists to ensure the socio-economic development of the Republic of Kazakhstan.
This Law regulates public relations in the field of science, scientific and (or) scientific and technical activities, commercialization of the results of scientific and (or) scientific and technical activities, defines the basic principles and mechanisms of functioning and development of the national scientific system of the Republic of Kazakhstan.
