Article 10. Places of movement of goods across the customs border of the Union of the Customs Code of the Eurasian Economic Union

Article 10. Places of movement of goods across the customs border of the Union of the Customs Code of the Eurasian Economic Union

     1. The movement of goods across the customs border of the Union is carried out at the places of movement of goods across the customs border of the Union, except in cases where the movement of goods across the customs border of the Union may be carried out in other places in accordance with paragraph 3 of this Article, and during the work of the customs authorities located in these places.

     2. The places of movement of goods across the customs border of the Union are checkpoints across the state borders of the Member States or other places determined in accordance with the legislation of the Member States.

     3. The movement of goods across the customs border of the Union may be carried out in places other than those specified in paragraph 2 of this Article, in cases and in accordance with the procedure determined in accordance with the legislation of the Member States.

     4. The places of movement of goods across the customs border of the Union through which the goods arrive in the customs territory of the Union are the places of arrival.

     The places of movement of goods across the customs border of the Union through which goods depart from the customs territory of the Union are the places of departure.

     Information on places of arrival and places of departure is sent by the customs authorities to the Commission for the formation of general lists of places of arrival and places of departure and their posting on the official website of the Union on the Internet.

     The forms of the general lists of places of arrival and places of departure, the procedure for their formation, maintenance and use of information from them, as well as the procedure and technical conditions, including the structure and format, for presenting information about places of arrival and places of departure are determined by the Commission.

     5. Certain categories of goods may arrive in the customs territory of the Union or depart from the customs territory of the Union only at the places of movement of goods across the customs border of the Union, determined in accordance with the legislation of the member States for the import (arrival) of such categories of goods into the customs territory of the Union or their export (departure) from the customs territory of the Union.

     6. The customs authorities have no right to restrict a person in choosing the place of movement of goods across the customs border of the Union, depending on the origin of the goods, the country of departure and destination of the goods.

     7. In order to inform about checkpoints across the state borders of the Member States located at the customs border of the Union, the Commission shall compile and post on the official website of the Union on the Internet an information and reference list of such checkpoints and a general register of passports of such checkpoints based on information about them provided by authorized state bodies of the member States.

     The forms of the specified list and register, the procedure for their formation, maintenance and use of the information contained therein, as well as the technical conditions, including the structure and format, for providing information on checkpoints across the state borders of the Member States located at the customs border of the Union, are determined by the Commission.

     8. The provisions of this Article shall not apply to the movement across the customs border of the Union of goods transported by pipeline transport or via power transmission lines. 

  

 The Customs Code of the Eurasian Economic Union was adopted on April 11, 2017.    

It was ratified by the Law of the Republic of Kazakhstan dated December 13, 2017 No. 115-VI SAM.
