1. Copyright in a work of architecture, urban planning and the relations arising in connection with it are regulated by this Code, the Civil Code of the Republic of Kazakhstan and the legislation of the Republic of Kazakhstan on copyright and related rights.

2. Individuals who have created works of architecture and urban planning as a result of their creative work are recognized as their authors and are granted the appropriate copyright.

3. The property rights of the authors of works of architecture and urban planning (except for the cases provided for by this Code, the Civil Code of the Republic of Kazakhstan and the legislation of the Republic of Kazakhstan on copyright and related rights) consist in their exclusive rights.:

1) to use or allow the use of a work of architecture, urban planning for the implementation of;

2) to carry out or permit the reproduction, distribution and processing of works of architecture and urban planning;

3) transfer the specified exclusive rights to other persons in accordance with the procedure provided for by the legislation of the Republic of Kazakhstan.

The property rights of the authors of works of architecture and urban planning extend to the architectural project, the concept of the urban project, as well as the architectural component (part) of the construction project.

4. The author(s) of works of architecture and urban planning created in the course of fulfilling official duties or an official assignment of an employer shall not be endowed with property rights, unless otherwise provided by the contract.

The contract between the customer (employer) and the authors (executors of the order) must contain provisions on the settlement of property rights for the use of works of architecture and urban planning created in the course of fulfilling official duties or official assignments of the employer.

5. The author(s) of a work of architecture and urban planning have the right:

1) provide author's supervision of the progress of construction (reconstruction, restoration, modernization) in accordance with the established procedure, unless otherwise provided by the contract for the development of a construction project;

2) to take photographs and videos, unless otherwise provided by the contract for the development of project documentation, as well as if the construction site does not contain information related to state secrets.

6. The protection of the personal non-property rights of the author(s) to a work of architecture and urban planning is carried out in accordance with the procedure established by the laws of the Republic of Kazakhstan.

7. The property rights of the author(s) to works of architecture and urban planning created at the expense of public investments belong to the authorized body for architecture, urban planning and construction and the state expert organization for the formation and maintenance of the state bank of construction projects, as well as the presentation of standard projects and design estimates developed at the expense of public investments.
