Article 10. Basic rights of convicts of the Penal Enforcement Code of the Republic of Kazakhstan
1. Convicted persons have the right to:
1) receiving information from institutions or bodies executing punishment on the procedure, conditions of serving a sentence and their changes;
2) filing a petition for pardon addressed to the President of the Republic of Kazakhstan in accordance with the legislation of the Republic of Kazakhstan;
3) making oral and written proposals, statements and complaints to the administration of the institution or body executing the punishment, to their higher authorities, the court, the prosecutor's office, other state bodies and officials, to public associations, as well as international organizations for the protection of human rights and freedoms in accordance with the legislation of the Republic of Kazakhstan;
4) recognition of their human dignity, protection from torture, violence, other cruel or degrading treatment or punishment;
5) personal safety while serving a sentence;
6) giving explanations and conducting correspondence, as well as making suggestions, statements and complaints in their native language or in any other language they speak, using the services of an interpreter in cases provided for by law.;
7) obtaining qualified legal assistance, including in the framework of providing state-guaranteed legal assistance, in the form of consultations, certificates, drafting legal documents, as well as in preparing documents submitted during the execution of sentences and court decisions in the cases provided for in paragraph one of part three of Article 475 and paragraphs 4), 5), 5-1), 11), 13), 15), 17), 19) and 22) articles 476 of the Criminal Procedure Code of the Republic of Kazakhstan, as well as in another form in accordance with the procedure established by the laws of the Republic of Kazakhstan.;
8) health protection and receiving qualified medical care in accordance with the legislation of the Republic of Kazakhstan in the field of healthcare;
9) psychological assistance provided by employees of the psychological service of the institution and other persons entitled to provide such assistance;
10) social and pension provision in accordance with the legislation of the Republic of Kazakhstan on social protection;
11) safe working conditions, rest, vacation, as well as remuneration in accordance with the labor legislation of the Republic of Kazakhstan.
Convicted persons have other rights in accordance with this Code, regulatory legal acts establishing the procedure and conditions for the execution and serving of sentences and other measures of criminal legal impact.
2. Convicted foreigners and stateless persons have the right to communicate with the diplomatic missions and consular offices of their states accredited in the Republic of Kazakhstan, and citizens of countries without diplomatic and consular offices accredited in the Republic of Kazakhstan – with the diplomatic missions of States that have assumed the protection of their interests, or international organizations that protect them.
3. Convicted persons with disabilities who have speech or hearing or visual impairments have the right to use the services of specialists who speak dactylic sign language or Braille.
4. Convicted persons cannot be subjected to clinical trials.
