Article 10-1. Persons who are not subject to fingerprint registration of the Law on Fingerprint and Genomic Registration

Article 10-1. Persons who are not subject to fingerprint registration of the Law on Fingerprint and Genomic Registration

     1. Children under the age of twelve are exempt from passing:

     1) fingerprint registration;

     2) identity verification procedures based on fingerprint information when crossing the State border of the Republic of Kazakhstan.

     2. On the basis of the principle of reciprocity, the following persons are exempt from undergoing fingerprint registration when applying for visas of the Republic of Kazakhstan:

     1) heads of foreign States, Governments, and international organizations with equivalent diplomatic status and their family members;

     2) members of parliaments, governments of foreign states, international organizations equated to diplomatic status, and members of their families – holders of diplomatic passports, as well as members of official foreign delegations and their accompanying persons – holders of diplomatic passports;

     3) Honorary Consuls of the Republic of Kazakhstan and their family members;

     4) holders of diplomatic passports, as well as passports of international organizations, who have the status equivalent to diplomatic agents traveling to the Republic of Kazakhstan on official business;

     5) diplomatic couriers carrying diplomatic mail are holders of diplomatic passports if they have a courier list.;

     6) foreigners and stateless persons arriving in the Republic of Kazakhstan at the invitation of the Administration of the President of the Republic of Kazakhstan, the Parliament of the Republic of Kazakhstan, the Supreme Court of the Republic of Kazakhstan, the Office of the Government of the Republic of Kazakhstan, special state bodies, the Ministry of Defense of the Republic of Kazakhstan, the authorized state body in the field of foreign policy.

     3. Persons who cross the State border of the Republic of Kazakhstan are exempt from the procedure of verifying identity based on fingerprint information.:

     1) holders of diplomatic passports;

     2) holders of diplomatic and official visas;

     3) foreigners and stateless persons at the written request of special state bodies, the Ministry of Defense of the Republic of Kazakhstan, the authorized state body in the field of foreign policy;

     4) citizens of the Republic of Kazakhstan who have undergone fingerprint registration.

     4. Persons who are excluded from the possibility of fingerprinting are exempt from undergoing mandatory fingerprint registration when processing identity documents based on the conclusion of the medical advisory commission. The list of diseases that are grounds for exemption from fingerprint registration is approved by the authorized body in the field of healthcare in coordination with the Ministry of Internal Affairs of the Republic of Kazakhstan.

     Foreigners and stateless persons subject to expulsion from the Republic of Kazakhstan or subject to international readmission treaties ratified by the Republic of Kazakhstan, who are missing all fingers on both hands or papillary patterns on the nail phalanges of all fingers of both hands, are subject to fingerprint registration on the palms of their hands.

     If a person is missing all fingers or hands on both hands, he is released from:

     1) undergoing fingerprint registration, unless otherwise provided by this Law;

     2) identity verification procedures based on fingerprint information when crossing the State border of the Republic of Kazakhstan.

The Law of the Republic of Kazakhstan dated December 30, 2016 No. 40-VI SAM.

     This Law regulates public relations in the field of fingerprint and genomic registration in the Republic of Kazakhstan.
