Article 1. The basic concepts used in this Law of the Law on Civil Protection
The following basic concepts are used in this Law:
1) accident – destruction of buildings, structures and (or) technical devices, uncontrolled explosion and (or) release of dangerous substances;
2) emergency rescue operations - actions to search and rescue people, material and cultural assets, provide emergency medical and psychological assistance to the population in an emergency zone, protect the environment in an emergency zone and during military operations, localize and suppress or bring to the lowest possible level of exposure to dangerous substances characteristic of them. factors;
3) an emergency rescue unit is an independent or part of a certified emergency rescue service, an organizational and structural unit of the civil protection forces designed to carry out emergency rescue and emergency operations.;
4) emergency rescue service – a set of organizationally integrated management bodies, emergency rescue units and civil protection equipment designed to solve emergency prevention and response tasks, functionally integrated into a single system;
5) an object with a mass stay of people is a building, structure, premises of trade enterprises, public catering, consumer services, physical education, sports, cultural, educational and entertainment organizations, entertainment facilities, railway stations of all types of transport, religious buildings (structures) designed for the simultaneous stay of one hundred or more people, as well as buildings and structures of healthcare, education, and hotels designed for simultaneous stays of twenty-five or more people;
6) civil defense is an integral part of the state civil protection system designed to implement a nationwide set of measures carried out in peacetime and wartime to protect the population and territory of the Republic of Kazakhstan from the effects of damaging (destructive) factors of modern weapons, natural and man–made emergencies;
7) military units of civil defense – military units of the authorized body in the field of civil protection that carry out civil protection measures in peacetime and wartime;
8) the fund of civil defense protective structures is a set of engineering structures specially equipped and designed to protect employees of organizations classified as civil defense and the population from the effects of damaging (destructive) factors of modern weapons;
9) civil defense protective structure – an engineering structure specially equipped and designed to protect the population from the effects of damaging (destructive) factors of modern weapons;
10) civil protection is a nationwide set of measures carried out in peacetime and wartime aimed at preventing and eliminating emergencies of a natural and man–made nature and their consequences, organizing and conducting civil defense, providing emergency medical and psychological assistance to the population in an emergency zone, including measures to ensure fire and industrial safety. and seismic safety, formation, storage and use of the state material reserve;
11) special measures of civil protection – early or prompt actions of civil protection services for engineering, radiation, chemical, medical, fire, transport, logistical, hydrometeorological and other work aimed at protecting the population, facilities and territory of the Republic of Kazakhstan from the dangers arising from emergency situations and military conflicts or as a result of these conflicts;
12) the civil protection notification system is a set of software and hardware tools that ensure that information is communicated to the public and government authorities about a threat to human life and health, and about the course of action in the current situation;
13) the state civil protection system is a set of governing bodies, forces and means of civil protection designed to implement a nationwide set of measures to protect the population, facilities and territory of the Republic of Kazakhstan from the dangers arising from emergencies and military conflicts or as a result of these conflicts.;
14) civil protection forces – military units of civil defense, emergency rescue services and formations, units of state, professional, branch fire services, civil protection formations, aviation and maritime organization of the authorized body in the field of civil protection, surveillance, situation control and forecasting services;
15) means of civil protection – material and technical property used to protect the population and equip civil protection forces;
16) civil protection services – republican, regional, city, district systems of government bodies and civil protection forces designed to carry out special civil protection measures;
17) civil protection bodies – the authorized body in the field of civil protection, its territorial bodies, departments and subordinate state institutions and enterprises;
17-1) employees of civil protection bodies – citizens of the Republic of Kazakhstan who serve in civil protection bodies, who have been awarded a special title;
18) state control and supervision in the field of civil protection – the activities of authorized bodies in the field of civil protection and in the field of industrial safety, aimed at ensuring compliance by individuals and legal entities with the requirements of the legislation of the Republic of Kazakhstan in the field of civil protection, within their competence;
19) the authorized body in the field of civil protection (hereinafter referred to as the authorized body) is the central executive body responsible for the management and intersectoral coordination in the field of civil protection in terms of preventing and eliminating natural and man–made emergencies, providing emergency medical and psychological assistance to the population, ensuring fire safety and organizing civil defense;
19-1) excluded by the Law of the Republic of Kazakhstan dated 06/24/2025 No. 196-VIII (effective ten calendar days after the date of its first official publication);
19-2) accreditation is the official recognition by the agency of the authority of an expert organization to carry out audit work in the field of fire safety;
19-3) accreditation certificate – a document issued by the agency certifying the right of an expert organization to carry out audit work in the field of fire safety;
20) the alert signal "Attention to all!" is a single alert signal transmitted through sirens or other signaling devices to attract the attention of the public in case of a threat or emergency.;
21) control points – structures or vehicles of state bodies specially equipped and equipped with technical means, life support elements, designed to accommodate and ensure the work of civil protection management bodies;
22) disbandment – the release of material assets from the state material reserve in the event of a change in the nomenclature, as well as for disposal or destruction, taking measures to prevent and eliminate emergencies and their consequences, providing regulatory impact on the market, assistance to refugees and humanitarian assistance;
22-1) spontaneous operations – actions carried out at oil and gas production facilities using special machinery, equipment and equipment aimed at eliminating accidents, saving people, material assets and reducing the impact of dangerous factors of uncontrolled release of reservoir fluids through the wellhead (gas and oil fountains) as a result of the absence, destruction or leakage of the shut-off valve. equipment or due to gryphon formation;
23) unified 112 dispatch service is a service for receiving and processing messages from individuals and legal entities about the prerequisites for the occurrence or occurrence of an emergency situation, fire, threat to life and harm to human health, and other cases requiring emergency measures, followed by coordination of emergency response actions within its competence.;
23-1) gas rescue operations – actions to eliminate accidents at hazardous production facilities, characterized by the need to perform them in conditions of environmental concentrations exceeding the maximum permissible concentrations of hazardous substances using special machinery, equipment and equipment, insulating personal protective equipment and related to the search for people in a polluted environment, providing first aid to victims and their transportation, conducting reconnaissance of the accident site with to clarify the location and cause of the accident, the boundaries of its spread, and other actions, necessary to eliminate hazardous production factors;
24) a volunteer firefighter is a citizen registered in the register of volunteer firefighters.;
25) mobilization reserve – a reserve of material assets according to a limited range, which is an integral part of the state material reserve, necessary to fulfill a mobilization order during mobilization, martial law and in wartime, to take measures to prevent and eliminate emergencies of a natural, man-made and social nature and their consequences, to provide humanitarian assistance in peacetime, and also, the logistical means of special formations;
26) victim – an individual who has suffered harm (damage) as a result of a natural or man-made emergency;
27) the causer of harm (damage) is a natural or legal person, as a result of whose action (inaction) a man–made emergency occurred.;
28) professional emergency rescue service - an emergency rescue service consisting of a formation or formations whose rescuers work on a regular basis and meet the qualification requirements;
28-1) professional fire service – legal entities that have passed certification for the right to carry out work on fire prevention and extinguishing, fire safety and emergency rescue operations related to extinguishing fires in organizations, settlements and facilities;
28-2) landslide hazard – the threat of a landslide process that can cause damage to human health, infrastructure and the environment;
29) excluded by the Law of the Republic of Kazakhstan dated 05/24/2018 No. 156-VI (effective ten calendar days after the date of its first official publication);
30) modern means of destruction – devices and means, the damaging (destructive) factors of which are designed to damage people, animals and plants, damage or destroy objects, the appearance of secondary damaging factors, including weapons of mass destruction and conventional means of destruction, including missiles, aircraft and firearms;
30-1) avalanche danger is a threat to human life and health, as well as damage to the environment and the economy, resulting from an avalanche from the slopes of mountains;
31) declaration of industrial safety of a hazardous production facility – a document that reflects the nature and extent of the danger of a hazardous production facility, measures to ensure industrial safety and protect the public from the harmful effects of hazardous production factors at the stages of commissioning, operation and decommissioning of a hazardous production facility;
32) dangerous production factor – a physical phenomenon that occurs during accidents, incidents at hazardous production facilities and social infrastructure facilities, causing harm (damage) to individuals and legal entities, the environment;
32-1) dangerous technical devices:
technical devices operating at a pressure of more than 0.07 megapascals or at a water heating temperature of more than 115 degrees Celsius, lifting mechanisms, escalators, funiculars, elevators, travelators, lifts for people with disabilities, as well as installations for drilling and repairing wells with a drilling depth of more than two hundred meters, mine lifting installations and lifting machines, mobile warehouses of explosives and products based on them, mixing-charging and delivery-charging machines, mobile and stationary installations for the manufacture of explosives and products based on them, operated at hazardous production facilities, state control and supervision of which are carried out by the authorized body in the field of industrial safety;
steam and hot water boilers operating at a pressure of more than 0.07 megapascals and (or) at a water heating temperature of more than 115 degrees Celsius (heat supply organizations), vessels operating at a pressure of more than 0.07 megapascals, lifting mechanisms, escalators, cable cars, funiculars, elevators, travelators, lifts for people with disabilities (persons with disabilities persons with disabilities) at social infrastructure facilities, which are subject to state control and supervision by local executive bodies;
33) rescuer – an individual who has received special training and has been certified (recertified) for emergency rescue operations.;
34) tangible assets – goods necessary to ensure the tasks assigned to the authorized body in the field of the state material reserve, in certain nomenclature and volume of storage of tangible assets of the state material reserve;
35) supply of material assets to the state material reserve – purchase and (or) shipment (delivery) of material assets to the points of storage of material assets of the state material reserve, a subordinate organization of the state material reserve system or an organization that has established mobilization orders;
36) placing of material assets in the state material reserve (hereinafter referred to as the bookmark) – acceptance of material assets for storage in the state material reserve;
37) release of material assets from the state material reserve – withdrawal of material assets from the state material reserve in the order of refreshment, borrowing, disbandment;
38) excluded by the Law of the Republic of Kazakhstan dated 06/24/2025 No. 196-VIII (effective ten calendar days after the date of its first official publication);
39) the state material reserve (hereinafter referred to as the state reserve) is a reserve of material assets intended for mobilization needs, taking measures to prevent and eliminate emergencies of a natural, man–made and social nature and their consequences, providing regulatory impact on the market, assistance to refugees and humanitarian assistance.;
39-1) authorized body in the field of the state material reserve – the central executive body responsible for the management and intersectoral coordination in the field of the state reserve;
40) the state fire service is a set of management bodies, forces and means of civil protection in regions, cities of republican significance, the capital, districts, cities of regional significance, designed to organize fire prevention and extinguishing, emergency rescue and emergency operations, state control and supervision in the field of fire safety and conducting inquiries on cases of criminal offenses related to fires;
41) a subordinate organization of the state reserve system is a legal entity that carries out the formation and storage of material assets of the state reserve on a contractual basis.;
42) transfer of material assets of the state reserve – transportation of material assets from one point of storage of material assets of the state reserve or a subordinate organization of the state reserve system or organizations that have established mobilization orders to another point of storage of material assets of the state reserve or a subordinate organization of the state reserve system or organizations that have established mobilization orders, including loading and unloading of material values;
43) borrowing of material assets from the state reserve is the release of material assets from the state reserve under certain conditions, followed by return to the state reserve in accordance with the nomenclature and storage volumes of material assets of the state reserve;
44) refreshment of the state reserve is the release of material assets from the state reserve before the expiration of the established storage periods, with simultaneous or intermittent laying of material assets in accordance with the nomenclature and storage volumes of material assets of the state reserve.;
45) standards for the storage of material assets of the state reserve – technical requirements for the content and conditions of storage of material assets of the state reserve;
46) storage facilities of the state reserve – legal entities that carry out on a contractual basis the storage of state reserve assets and the provision of services related to storage;
46-1) nomenclature and storage volumes of material assets of the state reserve – the list and volumes of material assets of the state reserve necessary to fulfill the tasks assigned to the authorized body in the field of the state material reserve;
47) object – property of individuals or legal entities, state property, including buildings, structures, technological installations, equipment, aggregates and other property to which requirements in the field of civil protection are established or should be established.;
48) incident – failure or damage of technical devices used at a hazardous production facility, deviation from the parameters ensuring the safety of the technological process, which did not lead to an accident;
49) operation – supply, storage and release of material assets of the state reserve;
49-1) production control – measures at a hazardous production facility aimed at ensuring compliance with industrial safety requirements, carried out by officials of the production control service;
50) industrial safety – the state of protection of individuals and legal entities, the environment from the harmful effects of hazardous production factors;
51) certificate of the right to carry out work in the field of industrial safety – a document issued by the authorized body in the field of industrial safety, certifying the right of a legal entity to carry out work in the field of industrial safety;
52) certification of legal entities for the right to carry out work in the field of industrial safety is the official recognition by the authorized body in the field of industrial safety of the legal entity's authority to carry out work in the field of industrial safety;
52-1) professional emergency rescue service in the field of industrial safety - an emergency rescue service designed to carry out mining, gas rescue, and anti–spontaneous operations at hazardous production facilities;
52-2) professional facility emergency rescue service in the field of industrial safety is an emergency rescue service that is a structural unit of an organization with hazardous production facilities.;
52-3) authorized body in the field of industrial safety – the central executive body responsible for the management and intersectoral coordination in the field of industrial safety;
52-4) excluded by the Law of the Republic of Kazakhstan dated 06/24/2025 No. 196-VIII (effective ten calendar days after the date of its first official publication);
53) industrial safety requirements – special technical and (or) social conditions established by the legislation of the Republic of Kazakhstan in order to ensure industrial safety;
54) gorenje – uncontrolled burning, posing a threat, causing harm to human life and health, material damage to individuals and legal entities, the interests of society and the state;
55) voluntary fire fighting formations are public associations established to carry out measures to prevent and extinguish steppe fires, as well as fires in organizations and settlements;
56) garrison of the fire service – a set of management bodies and divisions of the state fire service, professional fire services and voluntary fire fighting units located on the territory of the region, the city of republican significance, the capital, the district, the city of regional significance;
57) fire safety – the state of protection of people, property, society and the state from fires;
57-1) audit in the field of fire safety – business activity aimed at establishing the compliance or non-compliance of facilities with fire safety requirements;
58) fire safety requirements – special technical and (or) social conditions established by the legislation of the Republic of Kazakhstan in order to ensure fire safety;
59) fire safety measures – actions to comply with fire safety requirements;
60) fire station – the territory, buildings and constructions intended for placement of fire and special equipment, fire-technical armament, their maintenance, including office, auxiliary premises for personnel and a point of communication of division of fire service;
61) fire-technical products – products designed to ensure fire safety, including fire fighting equipment and equipment, fire fighting equipment, fire extinguishing and flame retardants, special communications and control equipment, software and databases, as well as other means of preventing and extinguishing fires;
61-1) branch fire service – regular or non-regular fire brigades at the facilities of the Armed Forces of the Republic of Kazakhstan, other troops and military formations, units or formations of air, inland waterway and railway transport, the state forest fund, designed to prevent and extinguish fires;
61-2) expert organization – an organization accredited in accordance with the established procedure to carry out audit activities in the field of fire safety;
61-3) seismic zoning (zoning) – classification of territories of the Republic of Kazakhstan according to the level of seismic hazard;
61-4) seismic safety – the state of protection of life and health of people, buildings, structures and infrastructure facilities from earthquakes;
61-5) seismological monitoring – monitoring of changes in seismic activity in the territory of the Republic of Kazakhstan, as well as collecting, processing, storing information and analyzing data received from seismological stations;
61-6) mudflow, landslide and avalanche hazard and risk maps – maps that define and display the zoning of the territory according to the degrees of mudflow, landslide and avalanche hazards and degrees of risk;
61-7) mudflow hazard is a threat from mudstone streams, which are sudden, rapid streams of water, mud, stones and trees moving along mountain slopes with high destructive force.;
62) natural emergencies – emergencies resulting from natural hazards (geophysical, geological, hydrological, meteorological, agrometeorological, hydrogeological hazards), wildfires, epidemics, diseases and pests affecting agricultural plants and forests;
62-1) mining rescue operations – actions carried out in mines, mines, quarries and sections using special machinery, equipment and equipment aimed at rescuing people and eliminating accidents, providing first aid to victims and transporting them, extinguishing fires underground and on the surface within a mining allotment, inerting an explosive atmosphere, dismantling rubble, the construction of bridges, the installation of supports, the elimination of flooding, and other actions necessary to eliminate hazardous production factors;
63) technical supervisor – a specialist who manages the technological process;
64) technical devices – machines, equipment and other structures;
65) man–made emergencies - emergencies caused by the harmful effects of hazardous production factors, transport and other accidents, fires (explosions), accidents with the release (threat of release) of highly toxic, radioactive and biologically dangerous substances, sudden collapse of buildings and structures, dam breaks, accidents on electric power and communication life support systems, sewage treatment plants;
66) emergency situation – the situation in a certain territory that has developed as a result of an accident, fire, harmful effects of hazardous industrial factors, a dangerous natural phenomenon, disaster, natural disaster or other disaster that may or may not result in human casualties, harm to human health or the environment, significant material damage and disruption of human living conditions;
67) emergency zone – the territory in which an emergency situation has developed;
68) emergency response manager – the main administrative and responsible person in charge of emergency response operations;
69) life support of the population in emergency situations – a set of measures interrelated in time, resources and place by civil protection forces and means aimed at creating and maintaining conditions minimally necessary to preserve life and maintain human health in emergency zones, on evacuation routes and in places of evacuation;
70) liquidation of emergency situations – carrying out emergency rescue and emergency work;
71) emergency response operations (hereinafter referred to as emergency operations) – activities aimed at comprehensive provision of emergency rescue operations, creation of conditions necessary to preserve human life and health;
72) prevention of emergency situations is a set of measures carried out in advance and aimed at maximizing the possible reduction of the risk of emergency situations, as well as at preserving human life and health, reducing the amount of material losses in the event of their occurrence.;
73) elimination of the consequences of emergency situations – measures taken to restore engineering infrastructure, housing, the environment, provide social rehabilitation assistance to the population, and compensate for harm (damage) caused to individuals and legal entities as a result of emergency situations;
74) classification of emergency situations – the procedure for classifying emergency situations into classes established in accordance with their danger to human life and health, violation of living conditions, and the amount of damage;
75) life support facility – organizations of healthcare, telecommunications, communications, gas supply, energy supply, heat supply, water supply and sanitation, upon termination (suspension) of operation of buildings, structures, technological installations and aggregates of which the activities of social and engineering infrastructures of settlements and territories are disrupted.;
76) aviation of the authorized body – an organization under the jurisdiction of the authorized body that uses aircraft to solve the main tasks of civil protection;
77) operational reserve of the authorized body – stocks of equipment and material assets, including medicines and medical devices, in certain nomenclature and volume;
77-1) a marine organization of an authorized body is a legal entity with one hundred percent state participation in the authorized capital, operating in accordance with this Law.;
78) the emergency medical and psychological assistance service of the authorized body is a professional medical emergency rescue service designed to carry out urgent work to provide medical and psychological assistance to the population in the emergency zone, to preserve, restore and rehabilitate the health of participants in emergency situations;
79) evacuation measures – the dispersal of employees of organizations classified as civil defense, the evacuation of the population and material resources from cities and emergency zones in peacetime and wartime.
