Article 1. The basic concepts used in this Law Chapter 1. General provisions of the Law on Veterinary Medicine

      The following basic concepts are used in this Law:  

     1) excluded by the Law of the Republic of Kazakhstan dated 28.10.2019 No. 268-VI (effective ten calendar days after the date of its first official publication);  

     1-1) zone is a conditionally limited territory, regardless of the administrative–territorial division, characterized by an epizootic situation for infectious animal diseases, in which antiepizootic measures are carried out in connection with an outbreak of a disease around its source or to protect this territory from the occurrence of infectious diseases.;

     2) a point with a disease problem (a problem point) is a territory where an epizootic outbreak is established.;  

     3) the database on identification of farm animals is a part of veterinary accounting that provides for a single, multi–level system for registering data on the individual number of an animal, on its veterinary treatments, including the results of diagnostic studies, as well as data on the owner of the animal, carried out by state veterinary organizations established by local executive bodies, and used by the authorized body;

     3-1) identification of farm animals is a procedure for recording animals, including assigning an individual number to animals by using products (means) for identification and labeling, including information about the farm animal in the database for identification of farm animals and issuing a veterinary passport;

     3-2) the issue of individual numbers of farm animals (hereinafter referred to as the issue of individual numbers) is a set of measures to determine the sequential numbering of individual numbers of farm animals and their distribution by administrative–territorial units of the republic;

     3-3) extract from the database on the identification of farm animals – information on the timing and nature of the veterinary measures carried out, including the results of diagnostic studies extracted from the database on the identification of farm animals by veterinary specialists of state veterinary organizations established by local executive bodies, at the request of animal owners in the manner and form approved by the authorized body;

     3-4) products (means) for the identification of farm animals – tags (mounted, with a radio frequency tag), boluses, chips and other products (means) used for the identification of farm animals;

     3-5) attributes for identification of farm animals – tools and devices used for identification of farm animals;

     3-6) laser marking station for products (means) for identification of farm animals (hereinafter referred to as the laser station) is an organization that applies an individual number to products (means) for identification of farm animals.;

     4) surveillance zone - the zone established between the buffer (protective) and safe zones;

     4-1) biological waste – materials, substances, remains of animal, plant and mineral origin (animal corpses, aborted and stillborn fetuses, veterinary seizures, feed waste) resulting from the death of animals, veterinary practical and scientific activities and experiments with living organisms and biological tissues (materials), as well as arising during the activities of production facilities that carry out animal husbandry, harvesting (slaughter), storage, processing and sale of animals, products and raw materials of animal origin, production organizations, storage and sale of veterinary medicines, feed and feed additives;

     5) buffer (protective) zone – a zone established to protect the zoosanitary status of a subpopulation of animals in a safe region or a region with an unspecified status by carrying out veterinary measures to prevent the introduction of an animal pathogen;

     6) veterinary medicine (field of veterinary medicine) is a field of special scientific knowledge and practical activities aimed at studying diseases and food poisoning (lesions) of animals, their prevention, diagnosis, treatment and elimination, ensuring compliance of objects of state veterinary and sanitary control and supervision with the requirements of the legislation of the Republic of Kazakhstan in the field of veterinary medicine, as well as protecting the population from diseases common to animals and humans;  

     7) veterinary control post – a subdivision of the department of the authorized body located on the territory of border and customs checkpoints (checkpoints across the State Border of the Republic of Kazakhstan, coinciding with the customs border of the Eurasian Economic Union), as well as in other places of movement of goods across the customs border of the Eurasian Economic Union, located on the territory of the Republic of Kazakhstan within the limits of automobile communication, and other places designated by the authorized body. a body equipped with the necessary equipment and devices, carrying out state veterinary and sanitary control and supervision of objects being moved (transported) and (or) receiving preliminary information on the import and transit of objects being moved (transported);

     8) veterinary (veterinary and sanitary) rules – a regulatory legal act that establishes veterinary (veterinary and sanitary, zoohygienic) requirements for objects of state veterinary and sanitary control and supervision, as well as defines the procedure for conducting veterinary activities based on veterinary standards, which is mandatory for individuals and legal entities.;

     9) veterinary documents – veterinary certificate, veterinary and sanitary certificate issued by the state veterinary and sanitary inspectors of the city of republican significance, the capital, the district, the city of regional significance for objects of state veterinary and sanitary control and supervision; a veterinary certificate issued by a specialist in the field of veterinary medicine of state veterinary organizations established by local executive bodies for animals, products and raw materials of animal origin, as well as by a veterinarian of the production control unit for determining the conformity of animals, products and raw materials of animal origin to veterinary standards in accordance with the procedure approved by the authorized body;

     10) veterinary passport is a document of the form established by the authorized body, issued in the form of an electronic document, in which, for the purposes of accounting for animals, the following are indicated: owner, type, gender, color, age (date of birth), individual number of the animal;

     11) veterinary drugs:

     substances intended for the prevention, diagnosis and treatment of animal diseases, obtained from blood, blood plasma, as well as organs of animals, plants, minerals by synthesis methods or using biological technologies;

      substances of plant, animal, or synthetic origin with pharmacological activity;  

     substances used as perfumes or cosmetics for animals;

     substances designed to increase animal productivity, disinfection, disinfection and deratization.

     The provisions of this subparagraph shall apply to medicinal products used (applied) in the field of veterinary medicine.;

     12) circulation of veterinary drugs, feed and feed additives – production, storage, transportation, approbation and registration tests (veterinary drugs and feed additives), conformity assessment, safety and quality control, advertising, sale or use of veterinary drugs, feed and feed additives;

     13) state registration of veterinary drugs and feed additives – registration by the authorized body of veterinary drugs and feed additives in the state registers of veterinary drugs and feed additives based on the results of their examination, approbation and registration tests and issuance of registration certificates in the prescribed form.;

     14) state registers of veterinary drugs and feed additives – lists issued by the authorized body containing information on veterinary drugs and feed additives that have passed state registration and are allowed for production, import and use in the Republic of Kazakhstan;

     15) registration tests of veterinary drugs and feed additives – determination of compliance of veterinary drugs and feed additives with safety and quality indicators;

     16) approbation of a veterinary drug, feed additives – testing of a veterinary drug, feed additives in limited laboratory and (or) production conditions in order to determine their immunobiological properties and epizootological effectiveness, the absence of consequences of their action on the animal's body, as well as environmental safety to establish the possibility of their use in veterinary practice;

     16-1) veterinary point – a separate subdivision of a state veterinary organization established by local executive bodies of the region to carry out activities in the field of veterinary medicine located in a city of regional significance, a settlement, a village, a rural district;

17) veterinary and sanitary safety - the condition of objects of state veterinary and sanitary control and supervision, which ensures animal health, food safety of products and raw materials of animal origin, veterinary and sanitary well-being of the territory, protection of the population from diseases common to animals and humans, as well as compliance of objects of state veterinary and sanitary control and supervision with the requirements of legislation of the Republic of Kazakhstan in the field of veterinary medicine;  

     18) veterinary and sanitary expertise - determination of the conformity of products and raw materials of animal origin, feed and feed additives to veterinary standards by a complex of organoleptic, biochemical, microbiological, parasitological, toxicological and radiological studies;

     19) laboratory of veterinary and sanitary expertise - a legal entity or a specialized subdivision of a legal entity that performs veterinary and sanitary expertise of products and raw materials of animal origin, feed and feed additives sold at domestic trade facilities and (or) in other places;

     19-1) veterinary specialist – an employee of departments of state bodies engaged in activities in the field of veterinary medicine, state veterinary organizations with higher, post-secondary or technical and professional education in veterinary specialties;

     20) veterinary measures - a set of antiepizootic, veterinary and sanitary procedures aimed at preventing the occurrence, spread or elimination of animal diseases, including their prevention, treatment or diagnosis; neutralization (disinfection), removal and destruction of animals infected with particularly dangerous diseases that pose a danger to animal and human health; increasing animal productivity; ensuring the safety of products and raw materials of animal origin, feed and feed additives, including the identification of farm animals, in order to protect animal and human health from infectious diseases, including those common to animals and humans;  

     21) the authorized body in the field of veterinary medicine (hereinafter referred to as the authorized body) is the central executive body responsible for leadership in the field of veterinary medicine, as well as inter-sectoral coordination within its powers.;  

     22) registration number - a code that includes the type of activity and the number of the production facility;  

     23) meat processing enterprise - a production complex where the slaughter of animals and processing of slaughter products are carried out, there is a slaughterhouse, production workshops, a department of veterinary and sanitary control and supervision and other auxiliary facilities that meet veterinary and sanitary standards and requirements;  

     24) veterinary examination of an animal is a clinical examination of an animal conducted in order to determine the general state of its health by a veterinarian, a state veterinary and sanitary inspector;

     25) pathogens of animal diseases - viruses, bacteria, rickettsias, chlamydia, mycoplasmas, prions, protozoa, fungi, helminths, mites, insects;  

     26) the reference function for the diagnosis of animal diseases is the implementation of typing (determining the type difference within a certain species) of pathogens of particularly dangerous, slow and exotic animal diseases, as well as making a definitive diagnosis in doubtful or controversial cases.;  

     27) products of animal origin - meat and meat products, milk and dairy products, fish and fish products, eggs and egg products, as well as bee products;  

     28) veterinary inspection of products and raw materials of animal origin – conducting an inspection of carcasses and organs of animals, products and raw materials of animal origin to identify visible changes, pathological signs of disease in them for the purpose of preliminary safety determination, carried out by a state veterinary and sanitary inspector, a veterinarian;

     29) raw materials of animal origin - skins, wool, hair, bristles, furs, down, feathers, endocrine glands, viscera, blood, bones, horns, hooves, other products obtained from animals, intended for animal feed and (or) used in industry;

     29-1) production facilities engaged in the production, harvesting (slaughter), storage, processing and sale of animals, products and raw materials of animal origin in a single technological cycle – production facilities (organizations) whose activities include the implementation of two or more processes (stages) of the technological cycle (production, harvesting (slaughter), storage and processing of animals, products and raw materials of animal origin);

     29-2) quarantine of animals – separate maintenance of newly arrived, imported, purchased, exported, transported animals for the purpose of diagnostic studies and veterinary treatments;

     30) especially dangerous animal diseases - animal diseases accompanied by rapid or widespread spread, high morbidity or mortality of animals, great socio-economic damage, including diseases common to animals and humans, determined by the authorized body;  

     31) contagious animal diseases - animal diseases resulting from the introduction of a specific pathogen of infection (invasion) into the animal's body and transmitted from animal to animal and human;

     32) non-communicable animal diseases - animal diseases resulting from violations of the rules of feeding, maintenance, care and economic use of animals and not transmitted from animal to animal and human;  

     33) enzootic diseases of animals – diseases of animals characterized by constant or frequently recurring manifestation in a certain area, socio-economic damage, determined by local executive bodies of regions, cities of republican significance, the capital;

     34) feed - products of plant, animal, mineral, microbiological, chemical origin used for animal feeding, containing nutrients in an digestible form and not having a harmful effect on animal health;  

     35) feed additive - substances of organic, mineral and (or) synthetic origin used as sources of missing nutrients, minerals and vitamins in the diet of animals;  

     36) quarantine is a legal regime providing for a system of veterinary and administrative measures aimed at limiting or terminating economic relations and suspending the transportation (movement) of relocated (transported) objects between an epizootic outbreak, an unfavorable point and the territory of veterinary and sanitary welfare in order to eliminate the epizootic outbreak and prevent the spread of the disease;

     36-1) compartment is a subpopulation of animals of one or more livestock farms with a unified biosafety management system, which has a certain zoosanitary status for one or more diseases, for which measures of veterinary control and supervision, prevention and biosafety are being taken for trade purposes.  

     The compartment may include facilities on the territories of which animals kept in the specified livestock farms are slaughtered, processing and storage of products of animal origin obtained from such animals, with the exception of facilities where exclusively products of animal origin that have passed technological stages guaranteeing their disinfection are stored or processed.;

     37) safe zone - a zone free from contagious animal diseases;  

     38) an unfavorable zone is an area where contagious animal diseases are detected.;

     38-1) is excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication).  

     39) movable (transported) objects controlled by the state veterinary and sanitary control and supervision (hereinafter referred to as movable (transported) objects) - animals, germ and somatic cells of animals, strains of pathogens of animal diseases, products and raw materials of animal origin, veterinary drugs, feed and feed additives, pathological material or samples taken from them, samples of water, air, soil, plants, products and attributes of veterinary and zoohygenic purposes, as well as used for their packaging and transportation all types of containers and vehicles transporting such movable (transported) objects;

     39-1) monitoring is a state system for monitoring the condition of objects of state veterinary and sanitary control and supervision, including their analysis, assessment and forecast, carried out in accordance with the procedure established by the authorized body.;

     39-2) regionalization is the process of determining the status of a state or its administrative-territorial unit (village, village, rural district, urban area, city, district, region) for a contagious disease in which a subpopulation of animals has a certain zoosanitary status for a contagious disease, in respect of which measures of veterinary control and supervision, prevention, elimination and provision of biological safety of facilities subject to state veterinary and sanitary control and supervision;

     39-3) processing center is a structural subdivision of the state veterinary organization established by the Government of the Republic of Kazakhstan, performing functions in accordance with this Law;

     40) an examination report (test report) is a document issued by veterinary laboratories based on the results of diagnostics or veterinary and sanitary examination of objects being moved (transported).;

41) slaughterhouse (slaughtering area for farm animals) - an adapted room (place), installed during the absence of meat processing enterprises or slaughterhouses, for slaughtering livestock in compliance with veterinary and sanitary rules and conducting a veterinary inspection of the animal and its slaughter products;  

     42) a slaughterhouse is a specialized facility equipped with equipment for slaughtering animals and primary processing of animal slaughter products that meets veterinary and sanitary standards and requirements, with veterinary and sanitary expertise;  

     42-1) registration is a procedure for entering information about laser stations, products (tools) and attributes for the identification of farm animals and their producers into the database for the issue of individual numbers.;

     42-2) is excluded by the Law of the Republic of Kazakhstan dated 04/06/2024 No. 71-VIII (effective sixty calendar days after the date of its first official publication).  

     43) domestic trade facilities – commercial facilities that sell animals, products and raw materials of animal origin, veterinary drugs, feed and feed additives, as well as catering facilities;

     44) restrictive measures - a legal regime providing for a system of veterinary, administrative and economic measures aimed at partially restricting economic relations and suspending the transportation (movement) of relocated (transported) objects in an epizootic outbreak and an unfavorable point in order to prevent the spread of animal diseases and achieve veterinary and sanitary well-being;

     44-1) emergency measures – measures for the immediate localization and elimination of foci of the spread of especially dangerous, exotic animal diseases for the first time or newly detected in the territory of the Republic of Kazakhstan in accordance with the procedure established by veterinary (veterinary and sanitary) rules.;

     45) epizootic is the mass spread of especially dangerous and other infectious animal diseases in the territory of the corresponding administrative-territorial unit.;  

     45-1) epizootological examination report – a document issued by a state veterinarian based on the results of studying the causes of epizootic foci and identifying conditions that promote or prevent the spread of animal diseases, as well as during animal quarantine;

     46) epizootic monitoring is a system for collecting quantitative data on the spread of animal diseases, including epizootic examination and information on the patterns of development of a particular animal disease, the natural, geographical and economic (economic) conditions of their habitat (maintenance, breeding), ongoing veterinary measures, and their subsequent statistical processing to analyze the effectiveness of veterinary measures and forecasting the emergence, development and elimination of epizootics or panzootics;  

     47) an epizootic focus is a limited area or room where the source of the causative agent of infection, transmission factors and susceptible animals are located.

This Law defines the legal, organizational and economic basis for carrying out activities in the field of veterinary medicine and is aimed at ensuring veterinary and sanitary safety.
