About some issues of the National Bank

In accordance with sub-paragraphs 1) and 3) of paragraph 2 of Article 17-1 of the Constitutional Law of the Republic of Kazakhstan dated December 26, 1995 "On the President of the Republic of Kazakhstan"
I DECREE:
1. To abolish the following departments of the National Bank of the Republic of Kazakhstan:
1) Committee for Control and Supervision of the Financial Market and Financial Organizations of the National Bank of the Republic of Kazakhstan;
2) Committee on Consumer Protection of Financial Services of the National Bank of the Republic of Kazakhstan.
2. To approve the attached amendments to some decrees of the President of the Republic of Kazakhstan.
3. The National Bank of the Republic of Kazakhstan shall take other necessary measures arising from this Decree.
4. This Decree shall enter into force from the date of signing.

CHANGES that are being made to some decrees of the President of the Republic of Kazakhstan
1. Abrogated by Decree of the President of the Republic of Kazakhstan dated 07/31/2023 No. 290.
2. To the Decree of the President of the Republic of Kazakhstan dated December 31, 2003 No. 1271 "On Approval of the Regulations and Structure of the National Bank of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 2004, No. 50, Article 640; 2005, No. 39, Article 555; 2006, No. 35, Article 373; 2007, No. 42 479; 2008, No. 3, Article 38; No. 35, Article 364; 2009, No. 15, Article 106; No. 55, Article 446; 2011, No. 29, Article 352; No. 34, Article 408; No. 52, Article 710; 2013, No. 8, Article 169; No. 30, Article 455):
in the Regulation on the National Bank of the Republic of Kazakhstan, approved by the above-mentioned Decree:
Delete paragraph 2;
The fifth part of paragraph 3 should be worded as follows:
"The representative and executive authorities of the Republic of Kazakhstan have no right to interfere in the activities of the National Bank of Kazakhstan, its branches, representative offices and organizations for the implementation of their legally established powers.";
in paragraph 4:
The first part should be worded as follows:
"4. The National Bank of Kazakhstan is a legal entity in the organizational and legal form of a state institution, has an independent balance sheet and, together with its branches, representative offices and organizations, forms a single centralized structure with a vertical chain of command.";
The fourth part should be worded as follows:
"The unified centralized structure of the National Bank of Kazakhstan includes a central office consisting of departments and other independent units, branches, representative offices and organizations.";
to exclude the seventeenth, eighteenth, nineteenth and twentieth parts;
The twenty-first part should be worded as follows:
"Other issues related to the internal activities of the National Bank of Kazakhstan are established by the regulations of the National Bank of Kazakhstan, regulations on structural divisions and other internal regulatory legal acts and legal acts of the National Bank of Kazakhstan.";
The twenty-eighth part should be worded as follows:
"Branches, representative offices and organizations of the National Bank of Kazakhstan have their own seal and letterheads of the established standard.";
Paragraph 16 should be worded as follows:
"16. In accordance with the tasks assigned to the National Bank of Kazakhstan, the National Bank of Kazakhstan, including its territorial branches, performs the functions specified in the Regulations.";

The first paragraph of subparagraph 13) should be worded as follows:
"13) publishes information on the official Internet resource of the National Bank of Kazakhstan on the issues (subparagraph 12) of paragraph 1 of Article 9 of the Law on State Regulation, Control and Supervision of the Financial Market):";
subparagraph 54) should be worded as follows:
"54) carries out administrative proceedings in cases of administrative offenses, the consideration of which falls within the competence of the National Bank of Kazakhstan (Article 573 of the Administrative Code);";
in paragraph 20:

Subparagraph 18) should be worded as follows:
"18) carries out administrative proceedings in cases of administrative offenses, the consideration of which falls within the competence of the National Bank of Kazakhstan, imposes penalties on financial market entities in accordance with the legislative acts of the Republic of Kazakhstan (Article 573 of the Administrative Code);";
Subparagraph 21) of paragraph 21 shall be worded as follows:
"21) carries out internal audit and verification of the activities of the divisions of the central office, branches, representative offices and organizations of the National Bank of Kazakhstan, as well as joint-stock companies of which the National Bank of Kazakhstan is the sole shareholder;";

"52) rules of appointment and termination of an employment contract with employees of the National Bank of Kazakhstan;
53) rules for the purchase of goods, works and services by the National Bank of Kazakhstan and legal entities in respect of which it is the founder (authorized body) or shareholder;";

Subparagraph 16) should be worded as follows:
"16) approves the working conditions, remuneration, social and household provision, advanced training and retraining of employees of the National Bank of Kazakhstan, its branches, representative offices and organizations;";
Sub-paragraph 36) should be deleted;
The second part of paragraph 24 should be worded as follows:
"The Board of Directors includes the Chairman of the National Bank of Kazakhstan, his deputies, heads of structural divisions of the National Bank of Kazakhstan on the recommendation of the Chairman of the National Bank of Kazakhstan. The composition of the Board of Directors of the National Bank of Kazakhstan is approved by the Chairman of the National Bank of Kazakhstan.";
in paragraph 25:
Sub-paragraphs 1) and 2) should be worded as follows:
"1) on the basis of the structure of the National Bank of Kazakhstan approved by the President of the Republic of Kazakhstan, approves the structure of the divisions of the central office, branches and representative offices of the National Bank of Kazakhstan, as well as the charters of the organizations of the National Bank of Kazakhstan;
2) approves the list of positions of technical employees of the National Bank of Kazakhstan;";
Subparagraph 12) should be worded as follows:
"12) carries out state regulation of the accounting and financial reporting system in the National Bank of Kazakhstan;";
in paragraph 29:
sub-paragraph 6) should be deleted;
Subparagraph 7) should be worded as follows:
"7) distributes responsibilities among the Deputy Chairmen of the National Bank of Kazakhstan, establishes the degree of responsibility of their deputies and heads of departments of the central office, branches, representative offices and organizations of the National Bank of Kazakhstan for the state of affairs in the assigned area of work;";
Subparagraph 11) should be worded as follows:
"11) on the basis of the total staffing of the National Bank of Kazakhstan approved by the President of the Republic of Kazakhstan, approves the staffing tables of the central office, branches, representative offices of the National Bank of Kazakhstan;";
Subparagraph 19) should be worded as follows:
"19) considers the results of inspections and the results of internal audits of the divisions of the central office, branches, representative offices and organizations of the National Bank of Kazakhstan, as well as joint-stock companies of which the National Bank of Kazakhstan is the sole shareholder.";
