Jurisdiction of civil cases of child adoption
Foreign citizens or citizens of the Republic of Kazakhstan wishing to adopt a child submit their Statement of Claim for the adoption of a child or children to the court at the place of residence or location of the child according to the rules of jurisdiction. Cases on the adoption of a child in the Republic of Kazakhstan are subject to the jurisdiction of Specialized Inter-district Juvenile Courts, which is specified in detail in part three of Article 27 of the Civil Procedure Code of the Republic of Kazakhstan, which provides that Specialized inter-district juvenile courts consider and resolve civil cases on disputes about the adoption of a child and its cancellation; on disputes arising from custody and guardianship (patronage) over minors and other disputes concerning minor children.
The law also allows that, at the request of the legal representatives of a minor, cases within the jurisdiction of a specialized interdistrict juvenile court may be considered or may be transferred to a district or city court at the child's place of residence or location, with the exception of cases within the jurisdiction of district or city courts located within cities of national significance and the capital, regional centers. The petition may be filed before the completion of the preparation of the case for trial. That is, if the child permanently resides far from the regional centers or the city where the Specialized Interdistrict Juvenile Court is located, in this case there is the possibility of considering the case of child adoption in court at the place of permanent residence of the minor child.
Citizens of the Republic of Kazakhstan permanently residing outside the territory of the Republic of Kazakhstan, as well as foreign citizens, including in cases where they permanently reside in the territory of the Republic of Kazakhstan, also submit an application for adoption to the specialized interdistrict juvenile court.
