Article 9. Professionalism On the Civil Service of the Republic of Kazakhstan 

      1. A civil servant’s professionalism shall be measured by their education, the possession of the competences required for the proper performance of their duties, their work experience – where this is established by the qualification requirements – and the efficiency with which they perform their duties.

      2. The efficiency of the performance of official duties shall comprise the achievement of the objectives set out in the Constitution of the Republic of Kazakhstan and the laws of the Republic of Kazakhstan, the performance indicators for public authorities—including those set out in the documents of the State Planning System of the Republic of Kazakhstan—and the timely and proper performance of official duties, instructions and acts issued by higher-level public authorities and officials.

      3. The qualifications and competencies of a candidate applying for a public office shall be confirmed by their compliance with the qualification requirements set for that specific public office.

      4. Effecient performance of official duties shall be measured based on this Law and acts of the President of the Republic of Kazakhstan.

Article 9. Basic rights of civil servants The Law on the Civil Service of the Republic of Kazakhstan

     A civil servant has the right to:

      1) enjoy the rights and freedoms guaranteed to citizens of the Republic of Kazakhstan by the Constitution and laws of the Republic of Kazakhstan;

     2) for legal and other protection in accordance with the legislation of the Republic of Kazakhstan in the event that he informs the superior head and (or) the management of the state body in which he works and (or) authorized state bodies about the cases of corruption offenses that have become known to him.;

     3) labor protection, health, safe and necessary working conditions for effective work;

     4) social and legal protection;

     5) to participate, within the limits of their official powers, in the consideration of issues and making decisions on them, and to demand their execution by the relevant bodies and officials;

     6) visit organizations in accordance with the established procedure for the performance of official duties;

     7) require the head to accurately define the tasks and scope of official powers in accordance with the public position held by a civil servant.;

     8) respect for personal dignity, fair and respectful treatment of oneself by managers, other officials and citizens;

     9) for incentives and remuneration depending on the public position he holds, the quality of work, experience and other grounds established by this Law;

     10) for training, retraining and advanced training at the expense of the relevant budget and funds of the National Bank of the Republic of Kazakhstan;

     11) to retain his place of work (public position) in cases where he is sent by a state body for training under a state order for postgraduate education programs in accordance with the legislation of the Republic of Kazakhstan or an internship, as well as in other cases provided for by the laws of the Republic of Kazakhstan;

     12) freely get acquainted with materials related to his public service, and, if necessary, provide personal explanations.;

     13) for promotion in the civil service, taking into account qualifications, competencies, abilities, merits and conscientious performance of their official duties;

     14) to demand an internal investigation in the presence of unfounded, in the opinion of the civil servant, charges;

     15) to be dismissed from public service at his own request, except in cases of consideration of his responsibility for a corruption offense or for disciplinary misconduct discrediting public service.;

     16) for pension and social security;

     17) receive, in accordance with the established procedure, information and materials necessary for the performance of official duties;

     18) to submit proposals to higher state bodies and officials on improving the civil service.

     Other rights of a civil servant may be established by the laws of the Republic of Kazakhstan and acts of the President of the Republic of Kazakhstan.
