Statement  

In, your proceedings previously had an arbitration case registered No. 01-10-296/24, in which an Arbitration Decision was made on January 08, 2025 and entered into force today.

By virtue of Part 2 of Article 253 of the Civil Procedure Code of the Republic of Kazakhstan (hereinafter referred to as the CPC), an application for the issuance of a writ of execution must comply with the requirements of the sub-paragraphs 1), 2), 3), 5), 7) and 8) parts two and four of Article 148 of this Code. The following documents are attached to the application for the issuance of a writ of execution:

1) the original or a copy of the award. A copy of the permanent arbitration award is certified by the head of this arbitration, a copy of the arbitration award for resolving a specific dispute must be notarized.;

2) the original or a notarized copy of the arbitration agreement concluded in accordance with the procedure established by law.

If the application submitted to the court does not comply with the requirements of this Article, it is subject to return without consideration in accordance with the procedure established by the second part of Article 152 of this Code.        

    Based on the above and guided by the SAM On Arbitration and art. 46 of the CPC RK,

 

I ASK FOR ARBITRATION:

·       Send the original of the arbitration award dated January 08, 2025 in arbitration case No. 01-10-296/24, to the address: Almaty, 050000, 79 Abylai Khan Ave., office 304;

·       To respond to the application within the prescribed time limits.
