The Republic of Kazakhstan and the Republic of Azerbaijan, hereinafter referred to as the Parties, striving to ensure favorable conditions for the exercise of their sovereign rights in the Caspian Sea, as well as to resolve in a spirit of mutual understanding and cooperation issues related to the effective use of the mineral resources of the seabed and subsoil of the Caspian Sea, taking into account that the existing legal regime of the Caspian Sea does not meet modern requirements and It does not fully regulate the relations of the Caspian littoral states, Calling upon the Caspian littoral States to conclude as soon as possible, on the basis of their common consent, a Convention on the Legal Status of the Caspian Sea, guided by the principles and norms of international law, the interests of the Parties in the development and use of the mineral resources of the seabed and subsoil of the Caspian Sea, and the existing practice in the Caspian Sea, based on the fact that the delimitation of the Caspian seabed by this Agreement does not apply to biological resources and use of the Caspian Sea for navigation purposes, Taking into account the bilateral agreements reached on the legal status of the Caspian Sea, we have agreed on the following:
Article 1
The bottom of the Caspian Sea and its subsoil are delimited between the Parties along a median line, which is based on an equal distance from the initial base points on the coastline and islands. The coordinates of the initial reference points are determined based on the average long-term level of the Caspian Sea, equal to minus 28 meters of the Baltic elevation system.
Article 2
The geographical description of the median line and its coordinates will be determined on the basis of cartographic materials and reference points agreed by the Parties and fixed in a separate Protocol, which will be an annex to this Agreement and its integral part.
Article 3
Within their bottom sectors, the Parties exercise sovereign rights for the purpose of exploration, development and management of the resources of the bottom and subsoil of the Caspian Sea, laying underwater cables and pipelines along the bottom of the Caspian Sea, creating artificial islands, berms, dams, overpasses, platforms and other engineering structures, as well as other legitimate economic activities on the bottom. The exploration and development of promising structures and deposits in the event of a median line passing through them will be the subject of separate agreements between the Parties.
Article 4
Differences in the interpretation and application of the provisions of this Agreement shall be resolved through negotiations and other peaceful means at the option of the Parties.
Article 5
This Agreement does not prevent the Caspian littoral States from reaching a general agreement on the legal status of the Caspian Sea and may be considered by the Parties as part of their general agreements.
Article 6
By mutual agreement of the parties, amendments and additions may be made to this Agreement, which are formalized in separate protocols that are an integral part of this Agreement.
Article 7
This Agreement shall enter into force on the date of the last written notification of its ratification.
Done in Moscow on November 29, 2001, in two original copies, each in the Kazakh, Azerbaijani and Russian languages, all texts being equally authentic. In case of disagreement in the interpretation of the provisions of this Agreement, the parties will be guided by the text in Russian.

The Republic of Kazakhstan and the Republic of Azerbaijan, hereinafter referred to as the Parties, based on the Agreement between the Republic of Kazakhstan and the Republic of Azerbaijan on the Delimitation of the Caspian Sea Floor between the Republic of Kazakhstan and the Republic of Azerbaijan dated November 29, 2001 (hereinafter referred to as the "Agreement"), in order to determine the geographical coordinates of the median line of demarcation of the seabed and subsoil of the Caspian Sea, have agreed as follows:
Article 1
By this Protocol, the Parties establish the geographical coordinates of the passage of the median line of demarcation of the seabed and subsoil of the Caspian Sea between the Republic of Kazakhstan and the Republic of Azerbaijan (Catalog of geographical coordinates of the median line of demarcation - Annex 1), which is based on equal distance from the initial base points on the coastline and islands (Catalog of geographical coordinates of the initial base points - Annex 2).
Article 2
The starting point of the median demarcation line is the junction of the demarcation lines of the seabed and subsoil of the Caspian Sea between the Republic of Kazakhstan, the Republic of Azerbaijan and the Russian Federation, with coordinates 42 o 33',6 north latitude and 49 o 53',3 east longitude. The endpoint of the median demarcation line is a point with coordinates 41 o 32',4 north latitude and 50 o 56',6 east longitude, which can be accepted as the junction point of the demarcation lines of the seabed and subsoil of the Caspian Sea between the Republic of Kazakhstan, the Republic of Azerbaijan and Turkmenistan, which should be fixed in a trilateral agreement between them.
Article 3
The median line of demarcation is plotted on the scheme of the median line of demarcation of the seabed and subsoil areas of the Caspian Sea between the Republic of Kazakhstan and the Republic of Azerbaijan agreed by the Parties (Appendix 3).
Article 4
This Protocol shall enter into force in accordance with the procedure provided for in Article 7 of the Agreement of which it is an integral part.
Done in Baku on February 27, 2003, in two original copies, each in the Kazakh, Azerbaijani and Russian languages, all texts being equally authentic. For the purpose of interpreting the provisions of this Protocol, the Parties will refer to the text in Russian.
