     To approve the agreement between the Government of the Republic of Kazakhstan and the Government of the Federal Republic of Germany on sending German teachers to schools in the Republic of Kazakhstan, signed in Bonn on November 26, 1997.

Agreement between the Government of the Republic of Kazakhstan and the Government of the Federal Republic of Germany on the admission of German teachers to schools of the Republic of Kazakhstan

     The Government of the Republic of Kazakhstan and the Government of the Federal Republic of Germany, seeking to further develop and deepen cooperation between the Republic of Kazakhstan and the Federal Republic of Germany, realizing the need to fulfill the tasks arising from the provisions of the Helsinki Final Act in the field of school education in Europe,        Expressing the desire to support Kazakh schools by sending German teachers and to preserve the cultural and national identity of German minorities in the Republic of Kazakhstan and contribute to the overall development of German language teaching and teaching of individual subjects in German, confident that a thorough knowledge of German language and culture in the Republic of Kazakhstan will make a valuable contribution to the further development of cultural ties between the two countries,        On the basis of the agreement on cultural cooperation between the Government of the Republic of Kazakhstan and the Government of the Federal Republic of Germany dated December 16, 1994, Agreed on the following:  

Article 1  

     The contracting parties agreed to provide support to schools in Kazakhstan by sending German teachers and specialists according to the methodology. German teachers will work in the field of training and advanced training of German teachers and teachers who teach certain subjects in German, and will teach German as their native language, in particular in the regions of the Republic of Kazakhstan where citizens of Kazakhstan of German origin live.

Article 2  

     1.before the beginning of the next academic year, the Government of the Republic of Kazakhstan, before December 31, informs the Government of the Federal Republic of Germany through diplomatic channels about the provided areas of activity, schools, disciplines, the required number of German teachers and their relevant qualifications.        2. No later than three months before the start of the academic year or, accordingly, before the start of classes, the Government of the Federal Republic of Germany informs the Government of the Republic of Kazakhstan through diplomatic channels about the surnames, disciplines and statements of qualifications of teachers who wish to assist the German side in their work in Kazakhstan. In addition to the period of validity of the necessary assistance, the notification must indicate the subjects and schools where individual teachers work as recommendations.  

Article 3  

     1.employers of teachers specified in Article 2 are competent Kazakh departments. They provide the selected teachers with written information indicating the place of work and conditions before their departure, and after their arrival in the Republic of Kazakhstan, they conclude a direct agreement with these teachers. This is how teachers get the same legal degree as domestic workers. The government of Kazakhstan provides them with social protection in the same way as it is provided to Kazakhstani teachers.        2.The employment contract is initially valid for the duration of one academic year. If it is not violated until six months before the end of this academic year, its validity may be extended by itself for another year, with the total validity period being repeated for a maximum of six years. The reasons for terminating the contract must be communicated to the partner under the contract.        3. teachers are required to conduct 25 lessons in German per week, the duration of which is in accordance with the established norms in the country. If necessary, they are required to conduct additional classes, but their number should not exceed three lessons per week and 40 lessons per year. However, in the case of completing special tasks, the weekly number of classes may be reduced.        4.during holidays in the Republic of Kazakhstan, these teachers may be used for no more than 4 weeks within the framework of summer courses, provided that they are granted at least 30 working days of continuous leave.        5.as payment under the contract, German teachers receive the usual Kazakh teachers ' wages, which must correspond to the wages of teachers with at least two years of experience in this school. Labor is also paid during the holidays.        6. The Government of the Republic of Kazakhstan provides German teachers with service apartments for rent in local currency at the usual local rates.  

Article 4  

     1.classes of German teachers can be attended by expert consultants, representatives of the Central Office of management of German schools abroad of the Federal Administrative Department and representatives of the permanent Conference of Ministers of Culture and education of the lands of the Federal Republic of Germany.        2.a representative of the permanent Conference of Ministers of Culture and education of the lands of the Federal Republic of Germany may request a German teacher a service description on behalf of his employer.

Article 5

     1.in addition to the contractual remuneration, the German side provides teachers with financial compensation, as well as a lump sum allowance for immigration costs.       2.the Government of the Republic of Kazakhstan exempts teachers specified in Article 2 from paying taxes and paying fiscal fees from income specified in Paragraph 1 of this article.

Article 6

     The degree of German teachers admitted to the trip is determined in accordance with the annex to the agreement on cultural cooperation between the Government of the Republic of Kazakhstan and the Government of the Federal Republic of Germany dated December 16, 1994 on the issues of the degree.

Article 7

     The Government of the Republic of Kazakhstan issues to the teachers specified in Article 2 the identity cards provided for foreigners who do not have a diplomatic rank.

Article 8

     The teachers referred to in Article 2 bear the same responsibility for the damage caused by them in connection with the performance of the teaching duties assigned to them in accordance with this agreement, to the extent that they are teachers of Kazakhstan within the framework of the current legislation of the Republic of Kazakhstan.  

Article 9  

     1.The Government of the Federal Republic of Germany will provide the Government of the Republic of Kazakhstan with the services of expert consultants and expert leaders who provide qualified advice to the competent authorities of Kazakhstan on all issues of teaching the German language and participate in the practical training of teachers of the German language and teachers who conduct classes in the German language in certain subjects. At the same time, one of the expert consultants performs the duties of a regulator, whose duties include regulating special and administrative issues of fundamental importance related to the sending of German teachers to the Republic of Kazakhstan. The specific conditions for the activities of expert consultants and expert supervisors will be regulated in the work manual, which is drawn up by agreement of the Contracting Parties.        2.official correspondence of teachers specified in Article 2 with any institutions is carried out through the regulator.        3. The fees for the services of expert consultants and expert supervisors are paid by the Federal Republic of Germany. The Government of the Republic of Kazakhstan does not collect taxes and fiscal fees from them.        4.the validity of articles 5-7 is extended to expert consultants and expert supervisors, respectively.  

Article 10  

     1.this Agreement shall enter into force from the date of mutual exchange of notes by the Contracting Parties on the implementation of internal state procedures for its entry into force. The decisive for determining the effective date is the date of receipt of the last note.        2.this agreement is concluded for an unlimited period of time.        3.each Contracting Party may terminate this agreement through diplomatic channels. In this case, the agreement ceases to exist six months after receiving a note about it from the second Contracting Party.        4. In accordance with Article 102 of the UN Charter on registration of this agreement in the Secretariat of the United Nations, the Government of the Federal Republic of Germany orders from the date of entry into force of the document. The second Contracting Party shall be notified of the registration after its approval by the UN Secretariat by specifying the UN registration number.       Created in Bonn on November 26, 1997, each in Kazakh, German and Russian, and all texts have the same power.        In case of differences of opinion in the interpretation of texts in Kazakh and German, the text in Russian is considered the main one.
