In accordance with paragraph 1 of Article 44 of the Constitutional Law of the Republic of Kazakhstan "On the Kurultai of the Republic of Kazakhstan and the status of its deputies", paragraph 2 of Article 32 of the Constitutional Law of the Republic of Kazakhstan "On the Judicial System and the Status of Judges of the Republic of Kazakhstan", Article 7 of the Constitutional Law of the Republic of Kazakhstan "On the Constitutional Court of the Republic of Kazakhstan", subparagraph 2) of Article 10 and by Article 21 of the Law of the Republic of Kazakhstan "On the Civil Service of the Republic of Kazakhstan" I DECREE:

1. To approve the attached Rules for taking the Oath of Office by civil servants, deputies of the Kurultai of the Republic of Kazakhstan, the Chairman of the Supreme Court of the Republic of Kazakhstan and judges of the Constitutional Court of the Republic of Kazakhstan.

2. To invalidate certain decrees of the President of the Republic of Kazakhstan in accordance with the annex to this Decree.

1. These Rules for taking the Oath of Office by civil servants, deputies of the Kurultai of the Republic of Kazakhstan, the Chairman of the Supreme Court of the Republic of Kazakhstan and judges of the Constitutional Court of the Republic of Kazakhstan (hereinafter – Rules) in accordance with paragraph 1 of Article 44 of the Constitutional Law of the Republic of Kazakhstan "On the Kurultai of the Republic of Kazakhstan and the status of its deputies", paragraph 2 of Article 32 of the Constitutional Law of the Republic of Kazakhstan "On the Judicial System and the Status of Judges of the Republic of Kazakhstan", Article 7 of the Constitutional Law of the Republic of Kazakhstan "On the Constitutional Court of the Republic of Kazakhstan", subparagraph 2) Articles 10 and Article 21 of the Law of the Republic of Kazakhstan "On the Civil Service of the Republic of Kazakhstan" define the procedure for taking the oath of office by civil servants, deputies of the Kurultai of the Republic of Kazakhstan, Chairman of the Supreme Court of the Republic of Kazakhstan and judges of the Constitutional Court of the Republic of Kazakhstan.

2. Civil servants take the oath of office once, with the exception of persons appointed to public office for the first time - the Vice President of the Republic of Kazakhstan, the Prime Minister of the Republic of Kazakhstan and other members of the Government of the Republic of Kazakhstan; the Head of the Presidential Administration of the Republic of Kazakhstan, his first deputy and deputies; the Chairman of the Supreme Court of the Republic of Kazakhstan; the Chairman of the Central Election Commission of the Republic of Kazakhstan; Head of the Office of the President of the Republic of Kazakhstan; assistants, advisers to the President of the Republic of Kazakhstan; Chairman of the Supreme Judicial Council of the Republic of Kazakhstan; heads of state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan; akims of the capital, regions, cities of republican significance.

3. Unless otherwise established by the President of the Republic of Kazakhstan, a political civil servant shall be sworn in upon presentation to the staff of the relevant state body by an official representing him, except for the cases provided for in this paragraph.
The President of the Republic of Kazakhstan directly takes the oath of office of the Vice President of the Republic of Kazakhstan, the Prime Minister of the Republic of Kazakhstan, the Head of the Presidential Administration of the Republic of Kazakhstan, the Chairmen of the Supreme Court of the Republic of Kazakhstan, the National Bank of the Republic of Kazakhstan, the Agency of the Republic of Kazakhstan for Regulation and Development of the Financial Market, the Central Election Commission of the Republic of Kazakhstan, the Prosecutor General of the Republic of Kazakhstan, the Chairmen of the National Security Committee of the Republic of Kazakhstan, the Supreme Audit Chamber of the Republic of Kazakhstan, Ministers of Foreign Affairs of the Republic of Kazakhstan, Defense of the Republic of Kazakhstan, Internal Affairs of the Republic of Kazakhstan.
Deputies of the Kurultai of the Republic of Kazakhstan take the oath at meetings of the Kurultai of the Republic of Kazakhstan.
Judges of the Constitutional Court of the Republic of Kazakhstan take the oath of office at a session of the Constitutional Court of the Republic of Kazakhstan.
At the discretion of the President of the Republic of Kazakhstan, other members of the Government of the Republic of Kazakhstan and heads of other state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, as well as deputies of the Kurultai of the Republic of Kazakhstan may be sworn in directly by the President of the Republic of Kazakhstan in the manner determined by him. When the President of the Republic of Kazakhstan convenes the first session of the Kurultai of the Republic of Kazakhstan, he takes the oath of his deputies to the people of Kazakhstan.
Officials appointed by the maslikhat or with its consent are sworn in at a meeting of the relevant maslikhat.

4. The official before whom the Chief of Staff of the Kurultai of the Republic of Kazakhstan and his deputies take the oath is determined by the Bureau of the Kurultai of the Republic of Kazakhstan.

5. A civil servant of the "A" corps, with the exception of one appointed with the consent of the maslikhat, is sworn in upon presentation to the staff of the relevant state body by an official representing him.
A civil servant of the B corps is sworn in by an official who has the right to appoint him to the position, or by another person authorized by him, within one month from the date of successful completion of the probation period.
6. The text of the oath of a deputy of the Kurultai of the Republic of Kazakhstan is established by the Constitutional Law of the Republic of Kazakhstan "On the Kurultai of the Republic of Kazakhstan and the status of its deputies".
The text of the oath of office of a member of the Government of the Republic of Kazakhstan is established by the Constitutional Law of the Republic of Kazakhstan "On the Government of the Republic of Kazakhstan".
The text of the oath of the Chairman of the Supreme Court of the Republic of Kazakhstan is established by the Constitutional Law of the Republic of Kazakhstan "On the Judicial System and the Status of Judges of the Republic of Kazakhstan".
The text of the oath of a judge of the Constitutional Court of the Republic of Kazakhstan is established by the Constitutional Law of the Republic of Kazakhstan "On the Constitutional Court of the Republic of Kazakhstan".
The text of the oath of a deputy of the Kurultai of the Republic of Kazakhstan, a member of the Government of the Republic of Kazakhstan, the Chairman of the Supreme Court of the Republic of Kazakhstan, a judge of the Constitutional Court of the Republic of Kazakhstan, an official in accordance with Appendix 1 to these Rules, another civil servant in accordance with Appendix 2 to these Rules, duly executed and printed in the state or Russian language, shall be pronounced in one of these languages, according to the choice of the person being sworn in.

7. The oath ceremony is usually held in the hall of the relevant office building. The swearing-in ceremony begins with an introductory speech by the official taking the oath. The person being sworn in is invited to the podium. Placing his hand on the Constitution of the Republic of Kazakhstan, he pronounces or reads out the text of the oath, then signs it and passes it to the official who took the oath.
The place of the oath ceremony is determined by the state body.
In addition to the persons being sworn in, other officials, close relatives of the official taking the oath, members of the public, and representatives of the media may be invited to the hall.

8. The form with the text of the oath indicating the date of taking the oath is kept in the materials of the personal file of the person sworn in.
An appropriate record of taking the oath of office is entered in the service record of a civil servant.
