On approval of the Rules for preparation, submission of the National Report on Combating Corruption to the President of the Republic of Kazakhstan and its publication

In accordance with paragraph 4 of Article 17 of the Law of the Republic of Kazakhstan dated November 18, 2015 "On Combating Corruption", I HEREBY DECREE:
1. To approve the attached Rules for the preparation, submission of the National Anti-Corruption Report to the President of the Republic of Kazakhstan and its publication.
2. This Decree comes into force on January 1, 2016 and is subject to official publication.

The rules of preparation, submission of the National Report on Anti-Corruption to the President of the Republic of Kazakhstan and its publication1. General provisions
1. These Rules for the preparation and submission of a National Report on Combating Corruption to the President of the Republic of Kazakhstan and its publication (hereinafter referred to as the Rules) have been developed in accordance with Article 17 of the Law of the Republic of Kazakhstan dated November 18, 2015 "On Combating Corruption" and define the procedure for the preparation, submission of a National Report on Combating Corruption to the President of the Republic of Kazakhstan and its publication.
2. The procedure for submitting materials to the authorized body for the formation of the National Report
2. State bodies, local executive bodies, quasi–public sector entities shall submit information on the ongoing work on combating corruption, the progress of the implementation of strategic and program documents, departmental and regional plans, plans of quasi-public sector entities on the issue of combating corruption to the authorized body for combating corruption (hereinafter referred to as the authorized body).
3. The information must contain:
1) information on the status and ongoing work in the field of anti-corruption;
2) the results of an internal analysis of corruption risks;
3) information on the execution or non-execution (reasons) of measures of plans for the implementation of strategic and program documents, departmental and regional plans, plans of quasi-public sector entities on the issue of combating corruption;
4) analysis of the impact of external factors on the ongoing work on combating corruption and the implementation of planned activities in this area;
5) information on the extent to which anti-corruption problems and tasks have been solved, the impact of this work on reducing corruption risks in the activities of a government agency, local executive body, quasi-public sector entity, socio-economic development of the industry, region, and others;
6) conclusions and proposals on the formation, implementation and improvement of anti-corruption policy, amendments to current legislation, including proposals for adjusting action plans for the implementation of strategic and programmatic documents;
7) Applications (as needed).
4. The information is signed by the first supervisor or the person replacing him, who ensures the accuracy and completeness of the information and the timeliness of its submission.
5. State bodies, local executive bodies, and quasi-public sector entities shall submit information to the authorized body by April 15 of the year following the reporting year.

6. If necessary, the authorized body may request information on anti-corruption issues from individuals and legal entities.
3. Procedure for preparation of the National Report
7. The national report is formed by the authorized body on the basis of information provided by state bodies, local executive bodies, quasi-public sector entities, individuals and legal entities, the results of the work of the authorized body, analysis and assessment of the state and trends of corruption at the international and national levels.
8. The structure of the National Report consists of the following sections:
1) Introduction;
2) the main part;
3) conclusion.
The introduction contains the basis and purpose of the presentation of the National Report and its summary.
The main part of the National Report contains data reflecting the essence, status and main results of the ongoing work on combating corruption, and includes:
1) information on the ongoing work on combating corruption by the authorized body, state bodies, local executive bodies, quasi-public sector entities, as well as individuals and legal entities;
2) information on the implementation of strategic and program documents, departmental and regional plans, plans of quasi-public sector entities on the issue of combating corruption;
3) assessment of the impact of the implemented anti-corruption policy on the socio-economic development of the country;
4) the results of sociological research to determine the level of anti-corruption culture and intolerance to corruption in society;
5) indicators of the Republic of Kazakhstan in the relevant ratings of international organizations and information on the state and trends of corruption at the international level.
The conclusion contains conclusions and proposals on the formation, implementation and improvement of anti-corruption policy, further development and improvement of work in this area, including the adjustment of strategic and program documents.
9. If necessary, the National Report may contain appendices, which are arranged in the order in which they are referenced in the text.
10. Based on the results of the review by the President of the Republic of Kazakhstan, if approved, the conclusions and proposals are the basis for further improvement of the country's anti-corruption policy.
4. The procedure for submitting a National Report to the President of the Republic of Kazakhstan and its publication
11. The national report is being submitted:
1) by the authorized body to the Administration of the President of the Republic of Kazakhstan no later than May 15 of the year following the reporting year;
2) The Administration of the President of the Republic of Kazakhstan to the President of the Republic of Kazakhstan no later than June 30 of the year following the reporting year.

12. The publication of the National Report in the republican mass media and its posting on the Internet resource of the authorized body shall be carried out by the authorized body no later than one month after its consideration by the President of the Republic of Kazakhstan.
