On approval of the Agreement between the Republic of Kazakhstan and the Republic of Belarus on socio-economic cooperation until 2026

In accordance with subparagraph 1) of Article 15 of the Law of the Republic of Kazakhstan dated May 30, 2005 "On International Treaties of the Republic of Kazakhstan", I HEREBY DECREE:
1. To approve the attached Agreement between the Republic of Kazakhstan and the Republic of Belarus on socio-economic cooperation until 2026, signed in Minsk on November 29, 2017.
2. This Decree shall enter into force from the date of its signing.

AGREEMENT between the Republic of Kazakhstan and the Republic of Belarus on socio-economic cooperation until 2026
The Republic of Kazakhstan and the Republic of Belarus, hereinafter referred to as the Parties,
Striving to further deepen the strategic partnership,
guided by generally accepted norms and principles of international law,
Emphasizing the need to increase and diversify trade and economic ties between the Republic of Kazakhstan and the Republic of Belarus,
Realizing the need to make more effective use of the economic, production, financial and other opportunities available to the Republic of Kazakhstan and the Republic of Belarus,
Considering the mutual interest in further strengthening and developing equal and mutually beneficial trade, economic and industrial relations, giving them a long-term and sustainable character, and making effective use of the economic, scientific and technical potential of the two states,
We have agreed on the following:
Article 1
The Parties are implementing a Program between the Republic of Kazakhstan and the Republic of Belarus on socio-economic cooperation until 2026 (hereinafter referred to as the Program), which is an integral part of this Agreement.
Article 2
Consideration of issues related to the implementation of the Program is carried out by the Intergovernmental Kazakh-Belarusian Commission on Trade and Economic Cooperation.
Article 3
The parties pay special attention to improving the contractual and legal framework of economic relations between the two countries.
The Parties shall assist in creating favorable economic conditions for the implementation of entrepreneurial and other economic activities, as well as the implementation of projects of mutual interest.
The Parties shall facilitate participation in privatization in accordance with their national legislation.
Article 4
The parties are developing bilateral economic, trade, scientific and technical ties, taking into account national priorities in the field of diversifying their economies and transferring them to a new technological basis.
The parties are deepening mutually beneficial cooperation in various sectors of the economy, primarily in the industrial, fuel and energy complex, construction, agriculture, and tourism.
The parties are expanding cooperation in the field of production, processing and promotion of agricultural products to the markets of both countries, deepening comprehensive ties between scientific organizations in the agricultural sector.
The parties cooperate in the field of socio-economic transformations carried out by them, develop production cooperation and create joint production enterprises.
The Parties conduct their foreign trade and economic policy based on the fundamental norms and principles of international law.
Article 5
Disagreements arising during the implementation of this Agreement shall be resolved through negotiations and consultations between the Parties.
Article 6
The provisions of this Agreement do not affect the rights and obligations of the Parties arising from other international treaties to which they are parties.
Article 7
The Parties may, by mutual agreement, make amendments and additions to this Agreement, which are integral parts of this Agreement, which are formalized in separate protocols and enter into force in accordance with the procedure provided for the entry into force of this Agreement.
Article 8
This Agreement shall enter into force on the date of receipt through diplomatic channels of the last written notification on the completion by the Parties of the internal procedures necessary for its entry into force, and is valid until December 31, 2026.
Termination of this Agreement does not affect the implementation of projects, the implementation of which, in accordance with the Program, was initiated during the period of validity of this Agreement.
Done in Minsk on November 29, 2017, in two original copies, each in the Kazakh and Russian languages, both texts being equally authentic and equally authentic.

I. Goals and objectives of the Program
This Program has been developed by the Republic of Kazakhstan and the Republic of Belarus (hereinafter referred to as the Parties) in order to implement a set of measures to further expand mutually beneficial economic, scientific and technical ties between the two countries, achieve significant progress in industrial cooperation between sectors of national economies and increase mutual trade on this basis.
To achieve these goals, this Program provides for cooperation between government agencies of the Republic of Kazakhstan and the Republic of Belarus in the following main areas::
in the field of economic cooperation:
further expansion and diversification of trade and economic cooperation on equal and mutually beneficial terms;
creating incentives for the growth of production, the introduction of the latest scientific achievements and advanced technologies, improving the quality and competitiveness of products;
development of industrial cooperation, creation of joint ventures and implementation of bilateral economic projects;
creation of conditions for fair competition for business entities located in the territories of both States;
development of cooperation in the monetary and financial sphere, coordination of regulation in the field of financial markets and expansion of mutual admission of financial market participants, improvement of regulation of the securities market infrastructure;
creation of an integrated commodity market;
joint participation in the implementation of infrastructure projects, including in order to strengthen strategic transit potential;
regular holding of trade and economic events (exhibitions, fairs, business forums, business meetings) in order to advertise the products of national producers and mutual promotion of goods;
cooperation on economic cooperation projects;
coordination of efforts in the development of mutually beneficial cooperation in the field of scientific and technical cooperation and information and communication technologies;
development of cooperation in the field of peaceful uses of atomic energy;
development of cooperation in the field of renewable energy sources;
participation of national companies in the construction and reconstruction of transport routes in the direction of Western Europe – Western China;
development of joint programs and projects in the field of peaceful space exploration;
development of innovative cooperation aimed at accelerated economic diversification;
creation of legal bases for the implementation of industrial cooperation;
development of interregional cooperation, cooperation in the field of investments, small and medium-sized businesses, and privatization;
development of cooperation in the field of state property management and privatization, maintenance of the state land cadastre;
implementation of cooperation in the field of emergency prevention and response;
expansion of cooperation in the field of environmental protection, forest and water resources management, and environmental monitoring;
mitigation of the effects of climate change and adaptation to climate change, rational use of natural resources;
exchange of open trade and economic information, as well as scientific and technical information of mutual interest;
in the field of the agro-industrial complex:
establishment of direct links and exchange of experience between the organizations of the agro-industrial sector of the Parties, including the expansion of cooperation in the production, processing, use of new technologies for storage and mutual supply of agricultural products;
scientific and technical cooperation on the issues of the agro-industrial complex, including the exchange of information on achievements in the field of scientific research;
in the field of transport and information technology:
development of transport and communication cooperation, using the advantageous geographical location of both countries to increase the competitiveness of existing transport corridors;
development of passenger and freight transportation, effective use of transit opportunities of the Parties;
expansion of cooperation in the field of information and communication technologies;
exchange of experience in the use of geographic information and globalization systems (QIS, GPS);
in the field of humanitarian cooperation:
preparation and implementation of measures to strengthen and develop humanitarian cooperation, interaction in social, cultural and other spheres;
development of cooperation in the field of education and culture, sports and tourism;
development of cooperation in the field of labor, employment and social protection of the population;
development of cooperation in the field of healthcare;
training of specialists of the appropriate level in an agreed list of specialties, promoting the expansion and development of mutual exchanges of specialists, scientists, graduate students and students;
expansion of mutual cooperation in the field of intellectual property.
II. Development of economic cooperation
The expansion and deepening of trade cooperation between the Parties is carried out through effective interaction within the framework of multilateral and bilateral contractual obligations, improvement of the settlement system, and creation of a climate of mutual trust in foreign economic activity in general, taking into account obligations under the Eurasian Economic Union.
The main areas of this cooperation include:
in accordance with the legislation of both states, assistance to the mutual participation of economic entities of the Parties in the privatization programs of facilities in the Republic of Kazakhstan and the Republic of Belarus;
formation and implementation of industry projects and cooperation programs.
The organization and implementation of trade relations between the two states presuppose an active exchange of necessary official statistical information, primarily the comparison of data on mutual trade.
In the process of implementing this Program, effective measures are being taken to strengthen and develop direct ties between the economic entities of the Republic of Kazakhstan and the Republic of Belarus, aimed at increasing the production of progressive types of products, effective integrated use of raw materials.
III. Coordination of measures to address joint social issues
During the implementation of this Program, the Parties shall pay attention to the development of mutually beneficial cooperation in the fields of healthcare, culture and art, sports, youth policy, tourism, labor, employment and social protection of the population, as well as in the field of training highly qualified personnel for various industries and the exchange of specialists, scientists, graduate students, interns and students.
The parties are taking measures to strengthen ties between the Republic of Kazakhstan and the Republic of Belarus in order to create favorable conditions for the socio-economic development of the regions.
IV. Program implementation mechanism
The implementation of this Program is carried out through the implementation by state bodies and economic entities of the Republic of Kazakhstan and the Republic of Belarus of specific actions provided for in this Program.
Coordination and control over the implementation of this Program is carried out by the Intergovernmental Kazakh-Belarusian Commission on Trade and Economic Cooperation.
In order to implement this Program, the chairmen of the national parts of the Intergovernmental Kazakh-Belarusian Commission on Trade and Economic Cooperation after the entry into force of the Agreement between the Republic of Kazakhstan and the Republic of Belarus on socio-economic cooperation until 2026 approve the Action Plan for the implementation of the Program.
Financing of expenses related to the implementation of this Program and activities is carried out at the expense of interested business entities of the Parties.
