On the streamlining of State control and supervisory functions
Decree of the President of the Republic of Kazakhstan dated September 7, 1999 No. 205.
In order to ensure the streamlining of state control and supervisory functions, I hereby decree:
1. To establish that State control and supervisory functions are performed only by State bodies.
2. Prohibit the transfer of state control and supervisory functions to state-owned enterprises and other organizations that do not have the status of a state body.
3. To the Government of the Republic of Kazakhstan, central and other state bodies within two weeks:
1) to bring previously adopted regulatory legal acts in line with this Decree;
2) ensure the revision of the constituent documents of legal entities subordinate to state bodies in order to exclude provisions providing for the granting of these legal entities the right to exercise state control and supervisory functions;
3) to develop and submit to the Parliament of the Republic of Kazakhstan bills providing for:
the possibility of exercising state control and supervisory functions only by State bodies;
the legal responsibility of government officials for the transfer of state control and supervisory functions to organizations that do not have the status of a government agency.
3-1. This Decree does not apply to the exercise of state control and supervision over the activities of civil and experimental aviation, taking into account the specifics provided for by the Law of the Republic of Kazakhstan "On the Use of the Airspace of the Republic of Kazakhstan and Aviation Activities".
The footnote. The Decree was supplemented by paragraph 3-1 in accordance with the Decree of the President of the Republic of Kazakhstan dated 09.10.2019 No. 183.
4. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.
5. This Decree comes into force from the date of signing.
