About the Agency of the Republic of Kazakhstan for the Protection of State Secrets
Decree of the President of the Republic of Kazakhstan dated May 13, 1999 No. 139
In accordance with subparagraph 3) of Article 44 of the Constitution and article 5 of the Law of the Republic of Kazakhstan "On State Secrets"
I decree:
1. To establish the Agency of the Republic of Kazakhstan for the Protection of State Secrets (hereinafter - the Agency) as a central executive body outside the Government of the Republic of Kazakhstan. see U020931
2. To establish that the Agency implements a unified state policy in the field of protection of state secrets.
3. Assign the following main functions to the Agency::
1) coordination of work to ensure secrecy in government agencies and organizations;
2) development of a system of legal, administrative, economic, technical, programmatic and cryptographic measures for the protection of state secrets, control over their implementation in the territory of the Republic of Kazakhstan;
3) coordination of the activities of the state secrets protection authorities in the interests of developing and implementing the state program, regulations and methodological acts for the protection of state secrets;
4) development of a List of government officials authorized to classify information as state secrets, and its submission to the Head of State for approval;
5) development of Instructions on ensuring the secrecy regime in the Republic of Kazakhstan;
6) development of a procedure for certification of technical means of protecting information constituting state secrets;
7) development of a procedure for determining the amount of damage caused or likely to be caused to the national security of the Republic of Kazakhstan or the interests of government agencies and organizations as a result of disclosure or loss of information constituting state secrets, as well as damage caused to the owner of information carriers as a result of their secrecy;
8) development of the procedure for classifying state bodies and organizations as special-regime, high-security and specially protected objects of the Republic of Kazakhstan;
9) development of a state program in the field of protection of state secrets and the procedure for logistical and financial support for the protection of state secrets;
10) organization of training and retraining of personnel of departments for the protection of state secrets;
11) providing practical and methodological assistance to government agencies and organizations on the protection of information constituting state secrets;
12) development of a procedure for special verification of citizens of the Republic of Kazakhstan in connection with their access to state secrets and its submission for approval to the Government of the Republic of Kazakhstan.
4. Add the following paragraph to paragraph 1 of the Decree of the President of the Republic dated January 22, 1999 No. 6 "On the structure of the Government of the Republic of Kazakhstan": "Agency of the Republic of Kazakhstan for the Protection of State Secrets".
5. To the Government of the Republic of Kazakhstan within one month:
1) to determine the staffing of the Agency by reducing the staffing of a number of central executive bodies;
2) to ensure the financing of the Agency from the appropriations provided for in the republican budget for 1999 and to provide annually in the draft republican budget funds for the maintenance of the Agency;
3) transfer to the Agency the necessary material and technical means and other property, to the extent of the functions assigned to the Agency and the staffing transferred to the Agency;
4) approve the position and structure of the Agency;
5) to bring previously issued acts of the Government of the Republic of Kazakhstan in accordance with this Decree; 6) to take other measures arising from this Decree.
6. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.
7. This Decree comes into force from the date of signing.
