On the introduction of a moratorium on the application of certain norms of land legislation

Decree of the President of the Republic of Kazakhstan dated May 6, 2016 No. 248.

In accordance with Article 40, subparagraph 3) of Article 44 of the Constitution of the Republic of Kazakhstan, I HEREBY DECREE:

     1. To introduce a moratorium on:

     1) application of the norms of the Law of the Republic of Kazakhstan dated November 2, 2015 "On Amendments and Additions to the Land Code of the Republic of Kazakhstan";

     2) granting foreigners, stateless persons, foreign legal entities, as well as legal entities in whose authorized capital the share of foreigners, stateless persons, and foreign legal entities is more than fifty percent, the right to temporary land use on the terms of lease of agricultural land;

     3) granting the right of private ownership to agricultural land plots owned by the state to individuals and legal entities.

     2. To the Government of the Republic of Kazakhstan:

     1) ensure the introduction of legislative amendments aimed at implementing paragraph 1 of this Decree;

     2) to form a Land Reform Commission;

     3) take other measures to implement this Decree.

     3. The General Prosecutor's Office of the Republic of Kazakhstan shall ensure supervision over the observance of legality in the implementation of paragraph 1 of this Decree.

     4. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.

     5. This Decree shall enter into force from the date of signing.
