On the reform of the public administration system of the Republic of Kazakhstan

Decree of the President of the Republic of Kazakhstan dated August 6, 2014 No. 875

In accordance with subparagraph 3) Article 44 of the Constitution of the Republic of Kazakhstan in order to modernize and improve the efficiency of the public administration system, optimize the state apparatus and form a compact Government of the Republic of Kazakhstan

I DECREE:    

1. Reorganize: 1) The Ministry of Finance of the Republic of Kazakhstan with the transfer of functions and powers in the field of budget planning from the Ministry of Economy and Budget Planning of the Republic of Kazakhstan; 2) The Ministry of Agriculture of the Republic of Kazakhstan with the transfer of functions and powers in the field of formation and implementation of state policy in the field of fisheries development, water resources management, forests, wildlife – from the Ministry of Environment and Water Resources of the Republic of Kazakhstan;      3) The Ministry of Internal Affairs of the Republic of Kazakhstan with the transfer to it of the functions and powers of the Ministry of Emergency Situations of the Republic of Kazakhstan, with the exception of functions and powers in the field of industrial safety, formation and development of the state material reserve.      

2. To establish: 1) The Ministry of National Economy of the Republic of Kazakhstan with the transfer of functions and powers to it: the Ministry of Economy and Budget Planning of the Republic of Kazakhstan, with the exception of functions and powers in the field of budget planning; the Ministry of Regional Development of the Republic of Kazakhstan; in the field of formation and development of the state material reserve – from the Ministry of Emergency Situations of the Republic of Kazakhstan; Agency Statistics Committee of the Republic of Kazakhstan; Agency of the Republic of Kazakhstan for Regulation of Natural Monopolies;      The Agency of the Republic of Kazakhstan for Protection of Competition (Antimonopoly Agency); the Agency of the Republic of Kazakhstan for Consumer Protection; 2) The Ministry of Culture and Sports of the Republic of Kazakhstan with the transfer of functions and powers to it: the Ministry of Culture of the Republic of Kazakhstan; in the field of archival affairs and documentation – from the Agency of the Republic of Kazakhstan for Communications and Information; the Agency of the Republic of Kazakhstan for religions; Agencies of the Republic of Kazakhstan for Sports and Physical Culture;      3) The Ministry of Investment and Development of the Republic of Kazakhstan, with the transfer of functions and powers to it: the Ministry of Industry and New Technologies of the Republic of Kazakhstan, with the exception of functions and powers in the field of formation and implementation of state policy in the field of electric power, atomic energy; the Agency of the Republic of Kazakhstan for Communications and Information, with the exception of functions and powers in the field of archival affairs and documentation; in the field of industrial safety – from the Ministry of Emergency Situations of the Republic of Kazakhstan;      The Ministry of Transport and Communications of the Republic of Kazakhstan; the National Space Agency of the Republic of Kazakhstan; 4) The Ministry of Energy of the Republic of Kazakhstan with the transfer of functions and powers to it: the Ministry of Oil and Gas of the Republic of Kazakhstan; in the field of formation and implementation of state policy in the field of electric power, atomic energy – from the Ministry of Industry and New Technologies of the Republic of Kazakhstan;      in the field of formation and implementation of state policy in the field of protection, control and supervision of the rational use of natural resources, solid household waste management, development of renewable energy sources, control over the state policy of the development of the "green economy" – from the Ministry of Environment and Water Resources of the Republic of Kazakhstan; 5) The Ministry of Health and Social Development of the Republic of Kazakhstan with the transfer of functions and powers to him: Ministry of Health of the Republic of Kazakhstan;      Ministry of Labor and Social Protection of the Population of the Republic of Kazakhstan.      

3. To abolish: Ministry of Economy and Budget Planning of the Republic of Kazakhstan; Ministry of Regional Development of the Republic of Kazakhstan; Ministry of Culture of the Republic of Kazakhstan; Ministry of Industry and New Technologies of the Republic of Kazakhstan; Ministry of Transport and Communications of the Republic of Kazakhstan; Ministry of Oil and Gas of the Republic of Kazakhstan; Ministry of Environment and Water Resources of the Republic of Kazakhstan; Ministry of Emergency Situations of the Republic of Kazakhstan; Ministry of Health of the Republic of Kazakhstan;      Ministry of Labor and Social Protection of the Republic of Kazakhstan; Agency of the Republic of Kazakhstan for Statistics; Agency of the Republic of Kazakhstan for Regulation of Natural Monopolies; Agency of the Republic of Kazakhstan for Protection of Competition (Antimonopoly Agency); Agency of the Republic of Kazakhstan for Consumer Protection; Agency of the Republic of Kazakhstan for Religious Affairs; Agency of the Republic of Kazakhstan for Sports and Physical Culture; National The Space Agency of the Republic of Kazakhstan; the Agency of the Republic of Kazakhstan for Communications and Information.      

4. To determine: 1) the newly formed and reorganized state bodies as legal successors of the rights and obligations of the abolished state bodies in accordance with the transferred functions and powers; 2) that the Prime Minister of the Republic of Kazakhstan has two deputies.      

5. The Government of the Republic of Kazakhstan shall ensure: 1) in coordination with the Administration of the President of the Republic of Kazakhstan, the redistribution of the staffing of reorganized and abolished state bodies; 2) comprehensive regulation of related areas of reorganized and newly created state bodies; 3) uninterrupted functioning of the system of central executive bodies during the reform provided for by this Decree.;      4) by January 1, 2015, amendments to the legislation of the Republic of Kazakhstan to ensure a clear distribution of competence between the Government and ministries, ministries and local executive bodies, to increase the independence of ministers, as well as the adoption of other measures to implement this Decree.      

6. Add to Decree of the President of the Republic of Kazakhstan dated January 22, 1999 No. 6 "On the Structure of the Government of the Republic of Kazakhstan" as follows::      Paragraph 1 should read as follows: "1. Based on the submission of the Prime Minister of the Republic of Kazakhstan, determine the following structure of the Government of the Republic of Kazakhstan: Office of the Prime Minister of the Republic of Kazakhstan; Ministry of Internal Affairs of the Republic of Kazakhstan; Ministry of Foreign Affairs of the Republic of Kazakhstan; Ministry of Culture and Sports of the Republic of Kazakhstan;      Ministry of National Economy of the Republic of Kazakhstan; Ministry of Defense of the Republic of Kazakhstan; Ministry of Investment and Development of the Republic of Kazakhstan; Ministry of Education and Science of the Republic of Kazakhstan; Ministry of Health and Social Development of the Republic of Kazakhstan; Ministry of Agriculture of the Republic of Kazakhstan; Ministry of Finance of the Republic of Kazakhstan; Ministry of Energy of the Republic of Kazakhstan; Ministry of Justice of the Republic of Kazakhstan.".    

7. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.      

8. This Decree shall enter into force from the date of its signing.
