On signing an Agreement between the Republic of Kazakhstan, the Kyrgyz Republic, the Republic of Tajikistan, Turkmenistan and the Republic of Uzbekistan on Friendship, Good-neighborliness and Cooperation for the Development of Central Asia in the 21st Century

Decree of the President of the Republic of Kazakhstan dated July 20, 2022 No. 963.

  In accordance with Article 8 of the Law of the Republic of Kazakhstan "On International Treaties of the Republic of Kazakhstan", I HEREBY DECREE:

     1. To approve the attached draft Agreement between the Republic of Kazakhstan, the Kyrgyz Republic, the Republic of Tajikistan, Turkmenistan and the Republic of Uzbekistan on Friendship, Good-neighborliness and Cooperation for the Development of Central Asia in the 21st Century.

     2. This Decree shall enter into force from the date of its signing.

Agreement between the Republic of Kazakhstan, the Kyrgyz Republic, the Republic of Tajikistan, Turkmenistan and the Republic of Uzbekistan on Friendship, Good-neighborliness and Cooperation for the Development of Central Asia in the 21st Century

     The Republic of Kazakhstan, the Kyrgyz Republic, the Republic of Tajikistan, Turkmenistan and the Republic of Uzbekistan, hereinafter referred to as the Contracting Parties,

     Considering the deep historical and cultural commonality of the peoples of the Central Asian States,

     Recognizing the exceptional importance and enduring value of State sovereignty, territorial integrity, and stability for the progressive development of the Central Asian States,

     Convinced that further strengthening of friendship, good-neighborliness and strategic partnership is in the fundamental interests of the peoples of the Central Asian States,

     proceeding from the mutual desire to consistently deepen political dialogue and intensify mutually beneficial multifaceted cooperation,

     Reaffirming their commitment to the universally recognized principles and norms of international law, especially the purposes and principles of the Charter of the United Nations,

     Realizing the high level of responsibility for ensuring stability, security and interethnic harmony in Central Asia, which are the basis for the sustainable development of the entire region,

     Recognizing the need for coordination and the importance of joint efforts to strengthen stability in the region,

     Expressing their determination to further promote the idea of regional cooperation aimed at the comprehensive development of the economic, water, energy, transport, logistics, tourism, cultural and humanitarian potentials of the Central Asian States, as well as improving the well-being and quality of life of citizens of all Contracting Parties,

     Noting the importance of further developing political dialogue and comprehensive cooperation within the framework of Consultative Meetings of the Heads of State of Central Asia as a fundamental platform for interaction between the Contracting Parties,

     Recognizing the importance of joint efforts to create a zone of peace and prosperity in Central Asia, as well as to achieve the lofty goals of regional cooperation in the 21st century, meeting the interests of all Contracting Parties,

     We have agreed on the following.

Article 1

     The Contracting Parties shall build their relations on the basis of mutual respect, equality, mutual understanding and comprehensive consideration of each other's interests.

     The Contracting Parties intend to consolidate their efforts in order to ensure lasting peace in the region and create favorable conditions for the sustainable and progressive development of the Central Asian States.

Article 2

     The Contracting Parties shall develop mutual relations based on trust, striving to establish and strengthen strategic partnership and multifaceted cooperation, as well as guided by the principles of mutual respect for State sovereignty, territorial integrity and inviolability of borders, non-interference in internal affairs and peaceful settlement of disputes, non-use of force or threat of force, mutual benefit and peaceful coexistence, respect for fundamental rights and freedoms. human rights, conscientious fulfillment of international obligations, other generally recognized principles and norms of international law.

Article 3

     The Contracting Parties shall mutually respect the paths of political, economic, social and cultural development chosen by each of the Contracting Parties.

Article 4

     The Contracting Parties closely cooperate in order to strengthen peace, stability and security in Central Asia, including regular five-party consultations on topical issues of regional and international agenda of mutual interest.

     In order to expand equal and trust-based partnership and strategic cooperation, the Contracting Parties are contributing to improving the effectiveness of the format of Consultative Meetings of the Heads of State of Central Asia, improving existing mechanisms for five-party cooperation, and, if necessary, creating other consultative and advisory bodies and intergovernmental structures.

Article 5

     The Contracting Parties shall provide each other with comprehensive support and mutual assistance in preventing threats to their independence, sovereignty and territorial integrity.

     In the event of a situation that poses a threat to the security, sovereignty and territorial integrity of one of the Contracting Parties, appropriate consultations can be held both bilaterally and within the framework of Consultative Meetings of the Heads of State of Central Asia in order to identify measures that contribute to the effective prevention of the threat.

Article 6

     The Contracting Parties confirm their firm commitment to refrain from the use of force or threat of force in interstate relations between themselves, undertake not to join military alliances, blocs or other associations of States directed against the Contracting Parties, as well as not to take part in actions directed against any of the Contracting Parties.

     In case of disputes, the Contracting Parties resolve them in a spirit of mutual respect and understanding exclusively within the framework of dialogue through peaceful diplomatic means, including through the creation of appropriate mechanisms of interaction, if necessary.

     The Contracting Parties undertake not to allow the use of their territories, communications systems and other infrastructure by third States to the detriment of the State sovereignty, security, stability, constitutional order and territorial integrity of any other Contracting Party.

Article 7

     The Contracting Parties shall cooperate to ensure peace and security in Central Asia.

     The Contracting Parties are developing cooperation in the military and military-technical fields on issues of mutual interest.

Article 8

     The Contracting Parties actively cooperate in the United Nations and make efforts to strengthen the central role of the United Nations as the most authoritative and universal international organization.

     The Contracting Parties expand cooperation within the framework of other international and regional organizations, provide support to each other when considering issues affecting their interests, and, if necessary, hold consultations to coordinate their positions on topical issues of the international situation, as well as take unified agreed positions on strengthening peace and security in Central Asia.

Article 9

     The Contracting Parties are strengthening cooperation in the field of non-proliferation of weapons of mass destruction, further strengthening the nuclear-weapon-free zone in Central Asia, actively promoting nuclear disarmament processes, and implementing measures to prevent the proliferation of all types of weapons of mass destruction.

Article 10

     The Contracting Parties, in accordance with their national legislation and international obligations, expand and deepen cooperation in countering new challenges and threats to security, including terrorism, extremism and separatism, transnational organized crime, cybercrime, illegal migration, human trafficking, illicit trafficking in weapons, narcotic drugs, psychotropic substances and their precursors.

     The Contracting Parties are making efforts to counter the spread of the ideology of terrorism and extremism, primarily among young people, and are working to prevent religious intolerance, xenophobia and ethnic discrimination.

Article 11

     The Contracting Parties shall encourage cooperation between their executive, legislative and judicial branches of government, promote the development and strengthening of cooperation between them, as well as political parties, public organizations and the media of the Central Asian States.

Article 12

     The Contracting Parties are taking all necessary measures to expand and deepen economic cooperation between the Central Asian States, including in the fields of trade, investment, industry, agriculture, transport, logistics, energy, tourism and other areas of mutual interest.

     The Contracting Parties cooperate within the framework of various international economic, financial and other organizations and institutions, supporting each other in participating or joining those international organizations of which one of the Contracting Parties is a member.

Article 13

The Contracting Parties are developing investment cooperation, including the promotion and mutual protection of investments, the creation of joint ventures, logistics and infrastructure facilities, and the implementation of joint projects aimed at improving the competitiveness of national economies and the well-being of the population of the Central Asian States.

     The Contracting Parties create favorable conditions for entrepreneurial and other economic activities, promote the development of various forms of associations and direct links between their citizens, enterprises and other subjects of economic cooperation.

Article 14

     The Contracting Parties shall promote the further development of the transit and transport potential of the region by making extensive use of existing and new railway, road, air and water communications, as well as by simplifying administrative procedures for cross-border transport.

     The Contracting Parties are taking the necessary measures to establish a network of industrial logistics and wholesale distribution centers in Central Asia in order to ensure favorable conditions for facilitating the transit of products and goods.

Article 15

     The Contracting Parties shall promote the development of interregional and cross-border cooperation and the creation of favorable conditions for the expansion of trade, economic, economic, cultural and humanitarian ties between their administrative-territorial units.

Article 16

     The Contracting Parties shall provide mutual assistance in carrying out the activities of each other's diplomatic, consular, trade and other official missions.

Article 17

     The Contracting Parties shall expand cooperation on the integrated and rational use of water and energy resources, taking into account the interests of all Contracting Parties in accordance with international treaties to which the Contracting Parties are parties.

Article 18

     The Contracting Parties are developing cooperation in the fields of environmental protection and environmental safety, combating desertification and climate change.

     The Contracting Parties coordinate efforts in preserving the ecological system of the Central Asian region, restoring biodiversity, as well as in the reclamation of uranium tailings dumps, primarily located in areas potentially exposed to natural disaster risks.

     The Contracting Parties shall provide mutual assistance in preventing and eliminating the consequences of natural disasters, major accidents and man-made disasters in their territories, as well as develop cooperation in combating the consequences of environmental disasters and anthropogenic impact on the natural environment.

Article 19

     The Contracting Parties shall unite and coordinate efforts to restore the ecological system of the Aral Sea basin and the Aral Sea region, and cooperate in the development and implementation of international and regional programs in this area.

     The Contracting Parties will make the necessary efforts to improve the organizational structure and legal framework of the International Fund for Saving the Aral Sea, taking into account the interests of all Central Asian States.

Article 20

     The Contracting Parties are expanding cooperation in the field of education.

     To this end, the Contracting Parties shall cooperate and create favorable conditions in the field of personnel training, exchange of scientists, specialists and students, and promote cooperation between educational institutions in every possible way, including in order to develop joint training programs and in other areas of mutual interest.

Article 21

     The Contracting Parties shall deepen cooperation in the field of fundamental and applied research, using the achievements of modern science, technology and technology, promote the expansion of scientific contacts on a long-term basis between national academies of sciences, scientific centers and higher educational institutions, encourage the implementation of common programs and projects, including in the field of digital and nanotechnology, artificial intelligence and other innovative technologies. technologies, assist in the creation and operation of joint scientific and scientific production associations, as well as international centers based on their scientific facilities.

Article 22

     The Contracting Parties shall develop cooperation in the field of exploration and use of outer space for peaceful purposes, conduct joint scientific research in this field and use their results in the interests of all Contracting Parties.

     The Contracting Parties cooperate and create favorable conditions in the field of personnel training, exchange of scientists, engineers and technical specialists in order to develop joint programs and projects in the space industry.

Article 23

     The Contracting Parties are developing cooperation in the information and communication sphere, including the exchange of experience and other interaction on the introduction and development of e-government, digitalization of economic sectors.

Article 24

     The Contracting Parties are developing cooperation in the field of healthcare.

     The Contracting Parties undertake joint actions to protect public health, combat epidemics, natural focal and other dangerous infections, develop medical science, exchange experience in the field of medical and pharmaceutical personnel training, introduce new remote technologies in the field of healthcare and the development of telemedicine.

     The Contracting Parties develop cooperation and exchange of experience between national epidemiological services through joint trainings, exercises, seminars, conferences and other events, as well as the implementation of regional projects and programs.

Article 25

     The Contracting Parties shall in every possible way contribute to the preservation of the spiritual and cultural community of peoples, ensure the protection of the ethnic, linguistic, cultural and religious identity of ethnic groups living in the territories of the Contracting Parties, create conditions for the preservation and development of this identity, and their equal participation in cultural, social and economic life, as well as in public affairs in accordance with national the laws of the Contracting Parties.

     The Contracting Parties shall support in their territories the activities of information and cultural centers of other Contracting Parties engaged in cultural, educational and informational work and maintaining links with national cultural associations in compliance with the requirements established by the legislation of the State of their location.

     The Contracting Parties undertake joint actions on international platforms to promote and popularize the common cultural and historical heritage of the Central Asian States.

     In order to strengthen the common cultural space based on the established historical community and interethnic ties, the Contracting Parties promote contacts between cultural, literary and artistic figures of the Central Asian States.

Article 26

     The Contracting Parties shall guarantee the protection of the legitimate rights and interests of citizens of other Contracting Parties residing or temporarily staying in their territories, and shall take measures to further facilitate migration requirements for each other's citizens.

     The Contracting Parties guarantee the protection of the legitimate rights and interests of citizens of other Contracting Parties who are or are staying on their territory, in accordance with national legislation and international obligations of the Contracting Parties.

Article 27

     In order to expand tourism opportunities, the Contracting Parties will make joint efforts to promote Central Asia as a unified cultural and historical region and tourism brand.

Article 28

     In order to implement this Agreement, the Contracting Parties shall adopt international treaties and other documents in specific areas of cooperation of mutual interest.

Article 29

     This Agreement does not affect the rights and obligations of the Contracting Parties arising from other international treaties to which they are parties.

Article 30

     By mutual agreement of the Contracting Parties, amendments and additions may be made to this Agreement, which are an integral part of it and are formalized in separate protocols.

Article 31

     In the event of disputes or disagreements in the interpretation or application of the provisions of this Treaty, the Contracting Parties shall resolve them through consultations and negotiations.

Article 32

     This Agreement is concluded for an indefinite period.

     This Treaty is subject to ratification by the Contracting Parties and enters into force on the thirtieth day after the receipt of the last instrument of ratification by the depositary.

     This Agreement is subject to registration with the United Nations Secretariat in accordance with Article 102 of the UN Charter.

     Each of the Contracting Parties has the right to withdraw from this Agreement by notifying the depositary in writing.

     In respect of such a Contracting Party, this Agreement shall terminate upon the expiration of six months from the date of receipt by the depositary of such notification.

     The Depositary shall inform the other Contracting Parties of the termination of this Agreement in respect of such Contracting Party.

     The Republic of Kazakhstan is the depositary of this Agreement.

     The Depositary shall send to each Contracting Party a certified copy of this Agreement.

     Done in Cholpon Ata on July 21, 2022, in one original copy in the Kazakh, Kyrgyz, Tajik, Turkmen, Uzbek and Russian languages, all texts being equally authentic.

For the purposes of interpreting the provisions of this Treaty, the Contracting Parties refer to the text in Russian.
