Decree of the President of the Republic of Kazakhstan dated April 21, 2000 No. 378.

In order to improve the activities of the Office of the President of the Republic of Kazakhstan, I hereby decree:

1. Approve the attached documents:

1) Regulations on the Office of the President of the Republic of Kazakhstan.

2) abrogated by Decree of the President of the Republic of Kazakhstan dated 08/18/2003 No. 1167. The footnote. Paragraph 1 as amended by Decree of the President of the Republic of Kazakhstan dated 08/18/2003 No. 1167.

2. To amend and supplement the following acts of the President of the Republic of Kazakhstan:

1) to the Decree of the President of the Republic of Kazakhstan dated November 6, 1995 No. 2600 "On the Management of the Affairs of the President of the Republic of Kazakhstan" (SAPP of the Republic of Kazakhstan, 1995, No. 35, art. 436):

subparagraph 1) of paragraph 3, after the words "state body", add the words "directly subordinate and";

Paragraphs 4 and 5 shall be declared invalid.

2) abrogated by Decree of the President of the Republic of Kazakhstan dated 11.02.2002 No. 805. Footnote. Paragraph 2 as amended by Decree of the President of the Republic of Kazakhstan dated 11.02.2002 No. 805.

3. Invalidate:

1) Decree of the President of the Republic of Kazakhstan dated March 26, 1996 No. 2918 "On Amendments and Additions to the Regulation on the Management of the Affairs of the President of the Republic of Kazakhstan, approved by Decree of the President of the Republic of Kazakhstan dated November 6, 1995 No. 2600" (SAPP of the Republic of Kazakhstan, 1996, No. 12, art. 88);

2) Paragraph 2 of Decree of the President of the Republic of Kazakhstan dated October 17, 1997 No. 3692 "On reorganization of the structure of the Office of the President of the Republic of Kazakhstan";

3) second paragraph, sub-paragraphs 1), 2), 3) and 4) of paragraph 3 of Decree of the President of the Republic of Kazakhstan dated August 31, 1998 No. 4034 "On measures to improve the structure of the Office of the President of the Republic of Kazakhstan".

4. The Government of the Republic of Kazakhstan should bring previously adopted acts into line with this Decree within one month.

5. This Decree comes into force from the date of signing.

Regulations on the Administration of the President of the Republic of Kazakhstan

1. General provisions

1. The Office of the President of the Republic of Kazakhstan is a state body directly subordinate and accountable to the President of the Republic of Kazakhstan, ensuring, in accordance with these Regulations, the activities of the President of the Republic of Kazakhstan, political civil servants, deputies of the Parliament of the Republic of Kazakhstan, government agencies and employees of their offices.

2. The Office of the President of the Republic of Kazakhstan has departments:

1) the state institution "Management of Logistics";

2) the state institution "Medical Center of the Office of the President of the Republic of Kazakhstan".

3. The Office of the President of the Republic of Kazakhstan carries out its activities in accordance with the Constitution, Constitutional Laws and laws of the Republic of Kazakhstan, acts of the President and Government of the Republic of Kazakhstan, other regulatory legal acts, as well as this Regulation.

4. The Office of the President of the Republic of Kazakhstan is a legal entity in the organizational and legal form of a state institution, has seals and stamps with its name in the official language, letterheads of the established sample, in accordance with the legislation of the Republic of Kazakhstan, accounts with treasury bodies.

The Office of the President of the Republic of Kazakhstan has an emblem, the description of which is approved by the Office of the President of the Republic of Kazakhstan (hereinafter referred to as the Office Manager).

5. The Office of the President of the Republic of Kazakhstan enters into civil law relations on its own behalf.

6. The Office of the President of the Republic of Kazakhstan has the right to act as a party to civil law relations on behalf of the state, if it is authorized to do so in accordance with the legislation.

7. The Office of the President of the Republic of Kazakhstan on matters of its competence, in accordance with the procedure established by law, makes decisions formalized by orders of the Business Manager and other acts provided for by the legislation of the Republic of Kazakhstan.

8. The structure and staff limit of the Office of the President of the Republic of Kazakhstan are approved by the President of the Republic of Kazakhstan.

9. Location of the Office of the President of the Republic of Kazakhstan: 8 Mangilik El Avenue, Nur-Sultan, 010000, Republic of Kazakhstan.

10. The full name in the official language is "Kazakhstan Republikasy Presidentinin Is Baskarmasy" memlekettik mekemesi.

The full name in Russian is the state institution "Office of the President of the Republic of Kazakhstan".

11. This Regulation is the founding document of the Office of the President of the Republic of Kazakhstan.

12. The activities of the Office of the President of the Republic of Kazakhstan are financed from the republican budget.

13. The Office of the President of the Republic of Kazakhstan is prohibited from entering into contractual relations with business entities for the performance of duties that are functions of the Office of the President of the Republic of Kazakhstan.

If legislative acts grant the Office of the President of the Republic of Kazakhstan the right to carry out income-generating activities, the income received from such activities is allocated to the state budget.

2. Mission, main tasks, functions, rights and duties of the Office of the President of the Republic of Kazakhstan

14. The mission of the Office of the President of the Republic of Kazakhstan is timely and high-quality logistical, social, medical and transport support for the activities of the President of the Republic of Kazakhstan, political civil servants, deputies of the Parliament of the Republic of Kazakhstan, government agencies and employees of their offices in accordance with these regulations.

15. Tasks of the Office of the President of the Republic of Kazakhstan:

1) material and technical support for the activities of the President of the Republic of Kazakhstan and his family members, the Prime Minister, the Chairmen of the Chambers of Parliament, the State Adviser, the Head of the Presidential Administration, Deputy Prime Ministers, members of the Government, deputies of Parliament, the Head of the Office of the Prime Minister, heads of the Chambers of Parliament, staff of the Presidential Administration and the Office of the Prime Minister, offices of the Chambers of the Parliament of the Republic of Kazakhstan, as well as other state bodies in coordination with the President of the Republic of Kazakhstan;

2) organization of logistical support for the activities of the Presidential Administration, Parliament, the Office of the First President of the Republic of Kazakhstan – Elbasy, the Office of the Prime Minister of the Republic of Kazakhstan, as well as other government bodies in coordination with the President of the Republic of Kazakhstan (hereinafter referred to as the serviced bodies);

3) social and household support for the activities of the President of the Republic of Kazakhstan and his family members, the Prime Minister, the Chairmen of the Chambers of Parliament, deputies of the Parliament of the Republic of Kazakhstan, as well as other persons in coordination with the President of the Republic of Kazakhstan;

4) transport and medical support for the activities of the persons specified in subparagraph 1) of this paragraph, as well as the Chairmen of the Constitutional Court, the Supreme Court, the National Bank, the Central Election Commission, the Supreme Judicial Council of the Republic of Kazakhstan, the Prosecutor General, the chairmen of the National Security Committee, the Supreme Audit Chamber of the Republic of Kazakhstan, the Business Manager, akims of the capital, cities republican significance and regions, judges of the Constitutional Court, members of the Central Election Commission, the Supreme Audit Chamber of the Republic of Kazakhstan, heads of the offices of the Constitutional Court, the Supreme Judicial Council of the Republic of Kazakhstan, as well as heads of state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan, in coordination with the President of the Republic of Kazakhstan (hereinafter referred to as the serviced persons);

5) financing, organization of logistical, medical support and servicing of meetings, conferences and other special events held by the President of the Republic of Kazakhstan, the Prime Minister, the Chairmen of the Chambers of Parliament, the State Adviser of the Republic of Kazakhstan, their information support;

6) material and technical, social, household, transport and medical support for the activities of the First President of the Republic of Kazakhstan - Elbasy and his family members living with him, as well as ex-Presidents of the Republic of Kazakhstan, related to the persons served;

7) organization of medical services for certain categories of civil servants and citizens according to the list approved by the Office of the President of the Republic of Kazakhstan in coordination with the Administration of the President of the Republic of Kazakhstan;

17-1) ensuring the functioning of the personal library of the President of the Republic of Kazakhstan, personal libraries and archives of former Presidents of the Republic of Kazakhstan.

16. Functions:

1) functions of the Office of the President of the Republic of Kazakhstan:

solves the issues of physical culture, recreation and social welfare of the serviced persons;

organizes work on providing housing for serviced persons, as well as employees of government agencies and other persons in coordination with the President of the Republic of Kazakhstan.;

organizes the design, construction and reconstruction of administrative, industrial, housing and social facilities, including facilities of subordinate enterprises, institutions and organizations;

Develops and approves current and prospective capital construction and repair programs, design estimates, organizes technical and design supervision of construction, and participates in the acceptance of completed construction projects.;

resolves issues of providing government agencies with administrative buildings, places the offices of government agencies and other organizations in administrative buildings, operates and maintains buildings under the jurisdiction of the Office of the President of the Republic of Kazakhstan;

provides transportation services to serviced persons and bodies in accordance with the unified transport policy, including air transportation of the President of the Republic of Kazakhstan and members of his family, the First President of the Republic of Kazakhstan – Elbasy and his family members living with him, ex-Presidents of the Republic of Kazakhstan, Prime Minister, Chairmen of the Chambers of Parliament, Head of the Presidential Administration, Deputy Prime Ministers, Business Manager, members of the Government of the Republic of Kazakhstan and official delegations, railway transportation of the President of the Republic of Kazakhstan and his family members, the First President of the Republic of Kazakhstan – Elbasy and his family members living with him, ex-Presidents of the Republic of Kazakhstan, the Prime Minister of the Republic of Kazakhstan, automobile transportation of the President of the Republic of Kazakhstan and his family members, the Prime Minister, chairmen of the Chambers of the Parliament of the Republic of Kazakhstan, as well as other serviced persons and bodies, develops and approves a program of transport support for serviced persons and bodies, organizes the purchase and repair of vehicles and other equipment;

organizes the operation of facilities on the balance sheet and under the jurisdiction of the Office of the President of the Republic of Kazakhstan, including guest residences, as well as the maintenance of premises, equipment, other property and the surrounding area in proper condition.;

organizes and ensures the functioning of a specially protected natural area under its jurisdiction;

oversees the organization of public catering, organizes physical education, cultural and social events, as well as the provision of services in buildings under the jurisdiction of the Office of the President of the Republic of Kazakhstan;

carries out the management, coordination and control of the activities of departments and subordinate organizations, fulfills the rights of the subject of the right of republican ownership in relation to the property of subordinate republican legal entities.;

oversees the financial activities of departments, subordinate organizations and other organizations under the jurisdiction of the Office of the President of the Republic of Kazakhstan;

In accordance with the procedure established by law, places a state order and monitors the targeted use of funds allocated for the state order.;

Approves development plans of subordinate organizations and reports on their implementation;

carries out monitoring, comprehensive analysis and support of informatization processes in the serviced bodies, as well as information and technical support, including the provision of information and communication infrastructures under its jurisdiction.;

organizes services, including medical services, for official events with the participation of the President of the Republic of Kazakhstan inside and outside the Republic, the First President of the Republic of Kazakhstan, Elbasy, the Prime Minister, the Chairmen of the Chambers of the Parliament of the Republic of Kazakhstan and delegations, develops and approves standards for representation costs;

organizes the production of necessary products and services at subordinate and other enterprises;

ensures the manufacture of printing products, coordinates the development of the printing base of the Office of the President of the Republic of Kazakhstan;

approves the annual financial statements of subordinate enterprises;

organizes and controls contractual and legal work in subordinate enterprises and other organizations under the jurisdiction of the Office of the President of the Republic of Kazakhstan;

In order to increase the efficiency of the use of fixed assets and production facilities, it attracts investors for the reconstruction, construction and development of facilities under its jurisdiction, as well as under the jurisdiction of subordinate organizations.;

provides methodological guidance on accounting and monitors the state of accounting and reporting in departments and subordinate organizations.;

develops and adopts regulatory legal acts on issues within the competence of the Office of the President of the Republic of Kazakhstan;

acts as the authorized body of the relevant branch of republican state-owned enterprises and the founder of state institutions and foundations, approves their charters.;

coordinates the activities of non-profit organizations (foundations) under his jurisdiction;

owns, uses and manages government shares and blocks of shares of legal entities;

controls the intended use and safety of state property assigned to subordinate enterprises, organizations and institutions, as well as transferred in accordance with the established procedure to other persons;

cooperates with government agencies and other organizations on issues within the competence of the Office of the President of the Republic of Kazakhstan;

performs other functions assigned to it by laws, acts of the President of the Republic of Kazakhstan and other legislation of the Republic of Kazakhstan;

2) Logistics Management functions:

provides financing, organization of logistical support and services for meetings, conferences and other official events held by the Parliament of the Republic of Kazakhstan, the Public Chamber and factions of political parties under the Mazhilis of the Parliament of the Republic of Kazakhstan;

organizes work on providing housing for deputies and staff of the Chambers of the Parliament of the Republic of Kazakhstan;

carries out work to create appropriate living and working conditions for deputies of the Parliament of the Republic of Kazakhstan;

in accordance with the established procedure, organizes transport support for serviced persons, purchase and repair of vehicles and other equipment.;

resolves, in accordance with the established procedure, issues of physical culture, recreation and social welfare of the persons served.;

develops and approves current and prospective programs for construction, reconstruction, capital repairs and design estimates, organizes the construction, reconstruction and overhaul of facilities of subordinate enterprises of the Logistics Department, organizes the design and construction of housing, social and industrial facilities;

carries out monitoring, comprehensive analysis, development and maintenance of informatization processes in the Parliament of the Republic of Kazakhstan;

organizes public catering in buildings under the jurisdiction of the Office of the President of the Republic of Kazakhstan;

organizes the operation of facilities on the balance sheet of the Logistics Department, as well as the maintenance of the premises, equipment and other property assigned to them, as well as the adjacent territory in proper condition.;

carries out the management, coordination and control of the work of subordinate enterprises of the Logistics Department, including improving the efficiency of using the property assigned to them.;

develops and approves standards for representative expenses, estimates of expenses for holding official events of the Parliament of the Republic of Kazakhstan at the expense of the republican budget, finances these expenses;

monitors the financial activities of subordinate organizations of the Logistics Department;

ensures the manufacture of printing products, coordinates the development of the printing base of the Parliament of the Republic of Kazakhstan;

provides financial assistance to the implementation of international cooperation of the Parliament of the Republic of Kazakhstan with other countries and international organizations;

performs other functions assigned to it by laws, acts of the President of the Republic of Kazakhstan and other legislation of the Republic of Kazakhstan;

3) functions of the Medical Center of the Office of the President of the Republic of Kazakhstan:

organizes diagnostic, therapeutic, preventive, rehabilitative and consultative medical care for the serviced persons (attached contingent) in subordinate medical organizations, including with the involvement of foreign specialists, and also directs the attached contingent for treatment abroad.;

organizes timely and high–quality medical care to the President of the Republic of Kazakhstan and his family members, the First President of the Republic of Kazakhstan - Elbasy and his family members living with him, ex-Presidents of the Republic of Kazakhstan with the use of necessary types and volumes of medical care and coordination of nutrition, prevention, rehabilitation and medical rehabilitation;

carries out the management and coordination of the work, as well as the financing of subordinate organizations of the Medical Center of the Office of the President of the Republic of Kazakhstan;

interacts with healthcare organizations that provide medical services, including through the conclusion of contracts;

organizes the provision of medicines and medical products to the attached contingent and medical and preventive organizations of the Medical Center of the Office of the President of the Republic of Kazakhstan;

organizes the dispatch of the attached contingent to the facilities of sanatorium-resort purposes of subordinate organizations of the Medical Center of the Office of the President of the Republic of Kazakhstan for rehabilitation treatment, rehabilitation and recreation;

carries out state sanitary and epidemiological supervision of facilities under the jurisdiction of the Office of the President of the Republic of Kazakhstan;

carries out epidemiological supervision of infectious diseases, organization and carrying out of preventive vaccinations to the attached contingent;

ensures sanitary and epidemiological safety of the attached contingent and sanitary and epidemiological welfare at facilities under the jurisdiction of the Office of the President of the Republic of Kazakhstan;

carries out expertise and control over the provision of medical services, advertising of medical services, as well as methods of prevention, diagnosis, treatment and medical rehabilitation in subordinate organizations;

coordinates and organizes the financing of educational activities of subordinate organizations, including preschool educational organizations;

organizes the introduction of modern achievements of medical science, information and innovative technologies in the work of subordinate organizations of the Medical Center of the Office of the President of the Republic of Kazakhstan;

performs other functions assigned to it by laws, acts of the President of the Republic of Kazakhstan and other legislation of the Republic of Kazakhstan.

17. Rights and duties of the Office of the President of the Republic of Kazakhstan:

1) request from government agencies, legal entities and individuals all necessary information and background information on all issues within the competence of the Office of the President of the Republic of Kazakhstan;

2) to direct the funds of subordinate enterprises for the preparation and implementation of investment projects;

3) to make proposals on the issues of creation, reorganization and

liquidation of subordinate organizations;

4) approve the nomenclature of employees of departments and subordinate organizations appointed in coordination with the Office of the President of the Republic of Kazakhstan;

5) conclude agreements with subordinate organizations on the terms of use of the state property assigned to them;

6) plan the activities of subordinate organizations and monitor the implementation of approved plans;

7) to attract investors for the reconstruction and construction of facilities under its jurisdiction, as well as for other purposes;

8) take all necessary measures to improve the efficiency of the activities of subordinate organizations in order to achieve their profitability, including approving the list of paid services provided by them, analyzing the results of their business activities, conducting inspections and documentary audits;

9) conclude agreements and agreements with international organizations and foreign legal entities in the areas of activity of the Office of the President of the Republic of Kazakhstan;

10) organize information technology protection activities in the computer systems of the serviced bodies;

11) organize cultural and concert events;

12) to study and predict the prospects for the development of information technologies, taking into account their application in the serviced bodies;

13) create, as well as act as a founder (participant) of another legal entity in the event that the rights of ownership, use, and management of state property are transferred to it in accordance with the established procedure.;

14) to carry out internal audit in the areas of activity;

15) take measures to identify, suppress and prevent violations in the use of funds from the national budget in accordance with the legislation of the Republic of Kazakhstan;

16) exercise other rights assigned to him by laws, acts of the President of the Republic of Kazakhstan and other legislation of the Republic of Kazakhstan.

3. Organization of activities of the Office of the President of the Republic of Kazakhstan

18. The management of the Office of the President of the Republic of Kazakhstan is carried out by the Business Manager, who is personally responsible for the fulfillment of the tasks assigned to the Office of the President of the Republic of Kazakhstan and the exercise of his functions.

19. The Business Manager is appointed and dismissed by the President of the Republic of Kazakhstan.

20. The Business Manager has deputies, including one first, whose competence includes the performance of tasks defined in subparagraph 6) of paragraph 15 of these Regulations.

The First Deputy Business Manager is appointed and dismissed by the First President of the Republic of Kazakhstan, Elbasy.

The Deputy Business Managers are appointed and dismissed by the President of the Republic of Kazakhstan upon the recommendation of the Business Manager.

21. Powers of the Business Manager:

1) determines the powers of his deputies, Chief of Staff and heads of departments of the Presidential Affairs Department;

2) submits to the Head of State for approval the Regulations on the Office of the President of the Republic of Kazakhstan, makes proposals on the structure and staffing of the Office of the President of the Republic of Kazakhstan;

3) in accordance with the procedure established by law, in coordination with the President of the Republic of Kazakhstan, appoints and dismisses the Chief of Staff, heads of departments of the Office of the President of the Republic of Kazakhstan and their deputies.;

4) appoints heads of subordinate enterprises and their deputies;

5) appoints and dismisses employees of the Office of the President of the Republic of Kazakhstan, except in cases provided for by laws, acts of the President of the Republic of Kazakhstan and other legislation of the Republic of Kazakhstan;

6) in accordance with the procedure established by law, impose disciplinary penalties on employees of the Office of the President of the Republic of Kazakhstan, heads of departments and subordinate enterprises of the Office of the President of the Republic of Kazakhstan, except in cases provided for by laws, acts of the President of the Republic of Kazakhstan and other legislation of the Republic of Kazakhstan;

7) issues orders, initializes drafts of regulatory legal acts developed by the Office of the President of the Republic of Kazakhstan;

8) approves projects in accordance with its authority

regulatory legal acts submitted for approval by the relevant

government agencies;

9) approves the staffing table of the Office of the President

Of the Republic of Kazakhstan, introduces amendments to it within the limits of the approved

full-time staff;

10) excluded by Decree of the President of the Republic of Kazakhstan dated 02/18/2016 No. 196.

11) approves, in accordance with the established procedure, the charters of subordinate enterprises of the Office of the President of the Republic of Kazakhstan, the salary fund and the official salaries of heads of subordinate enterprises, institutions and organizations;

12) approves plans for the development of subordinate enterprises;

13) approves, in accordance with the established procedure, estimates, projects, title lists for capital construction, reconstruction and major repairs of facilities under the jurisdiction of the Office of the President of the Republic of Kazakhstan;

14) approves the list of services provided by subordinates

enterprises and their prices;

15) coordinates the staffing tables of departments and subordinate enterprises of the Office of the President of the Republic of Kazakhstan;

16) represents the Office of the President of the Republic of Kazakhstan in government agencies and other organizations;

17) approves the work plans of the Office of the President of the Republic of Kazakhstan and subordinate organizations;

18) exercise other powers in accordance with the laws, acts of the President of the Republic of Kazakhstan and other legislation of the Republic of Kazakhstan.

The powers of the Business Manager during his absence are performed by the person replacing him in accordance with the current legislation.

22. The Business Manager determines the powers of his deputies in accordance with the current legislation.

23. The Office of the Office of the President of the Republic of Kazakhstan is headed by the Chief of Staff, who is appointed and dismissed in accordance with the current legislation of the Republic of Kazakhstan.

4. Property of the Office of the President of the Republic of Kazakhstan

24. The Office of the President of the Republic of Kazakhstan has separate property on the right of operational management.

The property of the Office of the President of the Republic of Kazakhstan is formed at the expense of property transferred to it by the owner, as well as property (including monetary income) acquired as a result of its own activities and other sources not prohibited by the legislation of the Republic of Kazakhstan.

25. The property assigned to the Office of the President of the Republic of Kazakhstan belongs to the republican ownership.

26. The Office of the President of the Republic of Kazakhstan does not have the right to independently alienate or otherwise dispose of the property assigned to it and property acquired at the expense of funds provided to it under the financing plan, unless otherwise established by law.

5. Reorganization and abolition of the Office of the President of the Republic of Kazakhstan

27. The reorganization and abolition of the Office of the President of the Republic of Kazakhstan is carried out in accordance with the legislation of the Republic of Kazakhstan.
