On some measures to improve the activities of the national security forces of the Republic of Kazakhstan

Decree of the President of the Republic of Kazakhstan dated June 26, 1999 No. 165

In accordance with subparagraph 3) of Article 44 of the Constitution of the Republic of Kazakhstan

I decree:      

 

1. Reorganize:      

1) The Ministry of Defense of the Republic of Kazakhstan by transferring the functions of managing the State Border Protection Forces of the Armed Forces of the Republic of Kazakhstan, their property and affairs to the National Security Committee of the Republic of Kazakhstan;      

2) The State border protection Forces of the Armed Forces of the Republic of Kazakhstan to the Border Guard Service of the National Security Committee of the Republic of Kazakhstan;      

3) The Higher Border Command School of the Armed Forces of the Republic of Kazakhstan to the Military Institute of the National Security Committee of the Republic of Kazakhstan. P931150      

 

2. Establish that:      

1) The Border Guard Service of the National Security Committee of the Republic of Kazakhstan is headed by the Deputy Chairman of the National Security Committee of the Republic of Kazakhstan - Director of the Border Guard Service;      

2) The Regulations on the Border Guard Service of the National Security Committee of the Republic of Kazakhstan are approved by the President of the Republic of Kazakhstan on the proposal of the Chairman of the National Security Committee of the Republic of Kazakhstan.      

 

3. Within two months, the Ministry of Defense of the Republic of Kazakhstan shall transfer, in accordance with the established procedure, to the jurisdiction of the National Security Committee of the Republic of Kazakhstan the personnel, staffing, as well as buildings, structures, transport, material, technical means, weapons and other material and financial resources of the State Border Protection Forces of the Armed Forces of the Republic of Kazakhstan and organizations reorganized in accordance with this Decree., including the Higher Border Command School , military medical institutions, aviation units and their support units, were present in the Border Troops of the Republic of Kazakhstan as of March 4, 1997.      

 

4. The Government of the Republic of Kazakhstan, together with the National Security Committee of the Republic of Kazakhstan, to develop and submit for consideration:      

1) proposals to the President of the Republic of Kazakhstan on bringing the current acts of the President of the Republic of Kazakhstan into line with this Decree;      

2) Proposals to the Parliament of the Republic of Kazakhstan on bringing existing legislative acts into line with this Decree.      

 

5. To the Government of the Republic of Kazakhstan:      

1) to provide financing for the activities of the Border Guard Service of the National Security Committee of the Republic of Kazakhstan, the Military Institute of the National Security Committee of the Republic of Kazakhstan at the expense of appropriations provided by the republican budget for 1999 for the maintenance of the State Border Protection Forces reorganized in accordance with this Decree, the Higher Border Command School, taking into account the transferred military medical institutions, aviation units and their security features;      

2) take other necessary measures arising from this Decree. R990102    

 

6. Within three months, the National Security Committee shall develop and submit to the President of the Republic of Kazakhstan for consideration a draft Regulation on the Border Guard Service of the National Security Committee of the Republic of Kazakhstan, as well as proposals on limiting the number of military personnel, workers and employees of the national security system.      

 

7. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.      8. This Decree comes into force from the date of signing.
