On measures to improve law enforcement activities in the Republic of Kazakhstan
Decree of the President of the Republic of Kazakhstan dated January 22, 2001 No. 536
In order to improve law enforcement activities in the Republic of Kazakhstan and in accordance with subparagraph 3) Article 44 of the Constitution of the Republic of Kazakhstan hereby decree:
1. To establish the Financial Police Agency of the Republic of Kazakhstan as a central executive body that is not part of the Government of the Republic of Kazakhstan, with the transfer to it of the functions and powers to manage the property and affairs of the abolished Tax Police Committee and the Tax Police Academy of the Ministry of State Revenue of the Republic of Kazakhstan. To entrust the Financial Police Agency of the Republic of Kazakhstan with the tasks of preventing, detecting and suppressing offenses in the field of economic and financial activities.
2. The Government of the Republic of Kazakhstan:
1) provide education The Committee on Intellectual Property Rights of the Ministry of Justice of the Republic of Kazakhstan with the transfer to it of functions and powers for the management of property and affairs of the Committee on Copyright of the Ministry of Justice of the Republic of Kazakhstan and the Republican State Enterprise for Patents and Trademarks "Kazpatent" of the Ministry of Justice of the Republic of Kazakhstan;
2) to abolish the Committee for the Execution of Judicial Decisions of the Ministry of Justice of the Republic of Kazakhstan with the transfer of functions and powers for the execution of executive documents, as well as staffing and property to the Committee for Judicial Administration under the Supreme Court of the Republic of Kazakhstan and its administrators in the regions and Astana, Almaty;
3) to approve the Regulations on the Financial Police Agency of the Republic of Kazakhstan;
4) to develop and submit to the Parliament of the Republic of Kazakhstan draft laws on amendments and additions to the current legislation providing for: - mandatory execution of acts and requirements of prosecutors, definition of the mechanism of their enforcement and establishment of responsibility of officials and citizens for non-fulfillment of requirements and acts of prosecutorial supervision; - depriving customs authorities of the functions and powers to carry out operational investigative activities while retaining the right to conduct inquiries in cases of smuggling and customs evasion; - transferring inquiries to internal affairs bodies in cases of crimes related to contempt of court and violations of the procedure for the execution of court decisions; - transfer of functions for the execution of executive documents and the fulfillment of tasks to ensure the established procedure for the activities of courts to the Committee on Judicial Administration under the Supreme Court of the Republic of Kazakhstan; 5) take other necessary measures arising from this Decree.
3. To make amendments and additions to the following Decrees of the President of the Republic of Kazakhstan: 1) to the Decree Of the President of the Republic of Kazakhstan dated January 22, 1999 No. 29 "On measures to further optimize the system of state bodies of the Republic of Kazakhstan": in Appendix 3, replace the numbers "34" and "193" with the numbers "64" and "1445", respectively; 2) abrogated by Decree of the President of the Republic of Kazakhstan dated September 22, 2010 No. 1066.
4. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.
5. This Decree comes into force from the date of signing.
