On measures to ensure socio-economic stability

Decree of the President of the Republic of Kazakhstan dated March 16, 2020 No. 286.

 In accordance with subparagraph 16) of Article 44 of the Constitution of the Republic of Kazakhstan, the Constitutional Law of the Republic of Kazakhstan dated December 26, 1995 "On the President of the Republic of Kazakhstan" in order to delineate powers between levels of government in crisis situations that pose or could pose a threat to the life and health of the population, the constitutional order, the protection of public order, the stable functioning of the state of the apparatus, I DECREE:

     1. To determine the following mechanism of functioning of public administration in the Republic of Kazakhstan for the period of crisis situations:

     1) The President of the Republic of Kazakhstan, as the highest official who determines the main directions of the domestic and foreign policy of the state and represents Kazakhstan within the country and in international relations, has the right to adopt acts or give instructions to state bodies, including those providing for a different regulation procedure in the socio-economic sphere on issues:

     organization and activities of state bodies and quasi-public sector entities, with the exception of issues regulated by the Constitution of the Republic of Kazakhstan;

     taxation, formation, clarification and use of the state budget;

     import and export of goods necessary for the uninterrupted life support of the population and the economy;

     State property management organizations;

     formation of the system and conditions of remuneration, social protection of citizens, state social and medical support, medical and social insurance;

     the establishment of marginal tariffs and prices for food and other goods necessary for the uninterrupted life support of the population and the economy;

     implementation of control and supervision;

     licensing, permissions, and notifications;

     implementation of public procurement;

     law enforcement;

     financial markets and financial organizations;

     implementation of the country's international obligations;

     antimonopoly legislation and competition protection;

     implementation of other functions and directions assigned to state bodies by the Constitution, laws and acts of the President and the Government of the Republic of Kazakhstan;

     2) The Government of the Republic of Kazakhstan, as the body heading the system of executive bodies and managing their activities, has the right to adopt acts or give instructions to state bodies and local executive bodies, including those providing for a different procedure, on issues provided for in subparagraph 1) of this paragraph, if there is direct competence in the acts and instructions of the President of the Republic of Kazakhstan.;

     3) state bodies directly subordinate and accountable to the President of the Republic of Kazakhstan have the right to adopt acts, including those providing for a different procedure, on the issues provided for in subparagraph 1) of this paragraph, if there is direct competence in the acts and instructions of the President of the Republic of Kazakhstan.;

     4) central and local executive bodies have the right to adopt acts, including those providing for a different procedure, on the issues provided for in subparagraph 1) of this paragraph, if there is direct competence in the acts and instructions of the President of the Republic of Kazakhstan, the Government of the Republic of Kazakhstan.

     2. To the Government of the Republic of Kazakhstan:

     1) within one month, submit to the Mazhilis of the Parliament of the Republic of Kazakhstan a draft law providing for amendments and additions to legislative acts aimed at the implementation of this Decree, including, if necessary, the redistribution of other functions.;

     2) take other measures to implement this Decree.

     3. Control over the implementation of this Decree is entrusted to the Administration of the President of the Republic of Kazakhstan.

     4. This Decree shall enter into force from the date of its signing.
