On amendments and additions to some legislative acts of the Republic of Kazakhstan on responsible treatment of animals
The Law of the Republic of Kazakhstan dated May 19, 2026 No. 292-VIII SAM.
Article 1. To make amendments and additions to the following legislative acts of the Republic of Kazakhstan:
1. To the Law of the Republic of Kazakhstan dated January 23, 2001 "On Local Government and Self-government in the Republic of Kazakhstan":
1) in article 27:
Add subparagraph 1-18) to paragraph 1 as follows:
"1-18) develops and submits for approval to the relevant maslikhat rules for animal husbandry, rules for keeping and walking pets, rules for trapping, temporary detention and killing of animals, proposals for establishing boundaries of sanitary animal husbandry zones;";
Paragraphs 1-9 should be supplemented with sub-paragraphs 7-1), 7-2) and 7-3) as follows:
"7-1) determines the places where it is prohibited to walk pets or stay with animals for another purpose, and also, if necessary, equips places for walking pets.;
7-2) organizes information support for the activities of animal shelters and social advertising aimed at transferring animals to new owners, searching for owners of lost animals, informing about the need for sterilization of pets;
7-3) organizes the regulation of the number of stray animals;";
2) paragraph 1 of Article 31 should be supplemented with sub-paragraphs 1-12), 1-13) and 1-14) as follows:
"1-12) defines places where it is prohibited to walk pets or stay with animals for another purpose, and also, if necessary, equips places for walking pets.;
1-13) organizes information support for the activities of animal shelters and social advertising aimed at transferring animals to new owners, searching for owners of lost animals, informing about the need to sterilize pets;
1-14) organizes the regulation of the number of stray animals;".
2. To the Law of the Republic of Kazakhstan dated July 10, 2002 "On Veterinary Medicine":
1) in article 10:
Sub-paragraphs 4-3) and 4-9) of paragraph 1 should be deleted;
Sub-paragraphs 23) and 27) of paragraph 1-1 should be deleted;
Sub-paragraph 1) of paragraph 2 should be deleted;
2) delete the seventh paragraph of the first part of paragraph 4 of Article 11.
3. To the Law of the Republic of Kazakhstan dated December 30, 2021 "On Responsible treatment of animals":
1) changes have been made throughout the text in Kazakh, the text in Russian does not change;
2) delete the preamble;
3) in article 1:
In subparagraph 1), replace the words "state veterinary organization established by local executive bodies of regions, cities of republican significance, and the capital" with the words "state legal entities established by local executive bodies of the capital, cities of republican significance, districts, and cities of regional significance";
Subparagraph 11) should be worded as follows:
"11) temporary animal detention facility – a property complex specially designed and equipped for the temporary detention of found, captured stray and stray animals, pets (companion animals) transferred by owners or responsible persons in connection with the refusal of their maintenance, as well as seized or confiscated from individuals or legal entities;";
add subparagraph 16-1) as follows:
"16-1) stray animals – dogs and cats that do not have an owner or are not registered pets;";
Sub-paragraph 18) should be deleted;
in subparagraph 26), the word "boluses," should be deleted;
add subparagraph 28-1) to read as follows:
"28-1) emergency response measures – a set of measures, including actions aimed at immediately eliminating and (or) minimizing the consequences of aggression by animals in order to ensure human safety, animals, public order and (or) preventing threats to human life or health, animals and property of individuals and (or) legal entities;";
4) Article 3 should be worded as follows:
"Article 3. The main goals, objectives and principles of this Law
1. The objectives of this Law are to ensure the protection and safety of animals, strengthen morality, respect for humanity, and protect the rights and legitimate interests of individuals and legal entities when handling animals.
2. The objectives of this Law are:
1) formation of owners' responsibility for the life, health and welfare of animals;
2) provision of a system of animal protection measures;
3) education of the population in a moral, humane and conscious attitude towards animals.
3. The legal regulation of public relations in the field of responsible treatment of animals is based on the principles of:
1) recognizing animals as beings capable of experiencing pain and physical suffering;
2) the inadmissibility of cruel treatment, infliction of pain, physical suffering and unjustified deprivation of animal life;
3) harmonious coexistence of humans and animals based on respect, care and balance of interests of society and nature.";
5) in article 4:
subparagraph 4) of paragraph 2, after the words "animal shelters", add the words "temporary animal detention facilities";
Paragraph 3 should be worded as follows:
"3. If further use of the animal for its intended purpose is impossible, the owner of the animal or the responsible person is obliged to ensure the maintenance of such an animal until its natural death or to transfer it to an animal shelter, a temporary animal shelter, to individuals or legal entities capable of creating the necessary conditions. When transferring an animal to a temporary animal detention facility, the owner or the responsible person is obliged to ensure its maintenance until the legal fate of the animal is determined.
If the animal's state of health, due to age-related changes, the presence of chronic diseases, or a post-traumatic condition, implies a deterioration in the animal's quality of life associated with regular pain or impaired organ systems or severe functional disorders of the musculoskeletal system, the animal's owner has the right to decide on euthanasia, according to the conclusion of the veterinarian.";
6) in article 7:
Subparagraph 1) should be worded as follows:
"1) on the basis of and in pursuance of the main directions of the domestic and foreign policy of the state, defined by the President of the Republic of Kazakhstan, and the main directions of the socio-economic policy of the state, its defense capability, security, and public order, developed by the Government of the Republic of Kazakhstan, formulates a state policy in the field of responsible treatment of animals in accordance with the current legislation of the Republic of Kazakhstan;";
add subparagraph 1-1) as follows:
"1-1) performs strategic, regulatory and implementation functions within its competence;";
subparagraph 6) should be worded as follows:
"6) develops and approves rules for the operation and accounting of animal shelters, as well as temporary animal detention facilities;";
sub-paragraph 7) should be deleted;
Sub-paragraphs 10) and 14) should be worded as follows:
"10) develop and approve a list of animals, the keeping, breeding and trafficking of which are prohibited or restricted, with the exception of the cases provided for in paragraph 3 of Article 10 of this Law;";
"14) develops and approves rules for the sterilization of stray animals, with the exception of dogs;";
add subparagraph 15-1) as follows:
"15-1) develops and approves regulatory legal acts in the field of responsible treatment of animals;";
7) in article 9:
in paragraph 1:
subparagraph 1) after the word "develop", add the words "and submit to the relevant maslikhat".;
subparagraph 5) after the word "develop", add the words "and submit to the relevant maslikhat".;
subparagraph 7) add the words "and temporary animal detention facilities";
Paragraph 1-1 should be supplemented with subparagraph 2-1) as follows:
"2-1) organize emergency response measures in accordance with the rules of trapping, temporary detention and killing of animals;";
Paragraph 1-2 should be supplemented with subparagraph 2-1) as follows:
"2-1) organize emergency response measures in accordance with the rules of trapping, temporary detention and killing of animals;";
8) in article 10:
Paragraph 3 should be worded as follows:
"3. The keeping and use of animals included in the list of animals, the keeping, breeding and trafficking of which are prohibited or restricted, is not allowed, except in the following cases::
1) temporary detention in semi-voluntary conditions, artificially created habitat or captivity of injured and (or) injured animals included in the list of animals whose maintenance, breeding and trafficking are prohibited or restricted, in a condition that does not allow them to be returned to their habitat, until they are transferred to animal shelters, zoological nurseries, animal rehabilitation centers, scientific organizations, as well as organizations that rehabilitate and reintroduce wild animals;
2) keeping animals in semi-free conditions, artificially created habitat or captivity for the duration of animal treatment and artificial feeding of cubs and young animals by employees of scientific organizations, animal shelters, zoological nurseries, animal rehabilitation centers, organizations engaged in the rehabilitation and reintroduction of wild animals, if there are appropriate decisions of these organizations.;
4) other cases stipulated by the laws of the Republic of Kazakhstan.";
in paragraph 4, replace the words "at the expense of budgetary funds in accordance with the legislation of the Republic of Kazakhstan, as well as others" with the words ", except for dogs, at the expense of";
9) paragraph 1 of Article 11 should be supplemented with the second part as follows:
"Accounting for dogs and cats is carried out using a chip as a mandatory pet accounting product.";
10) in article 13:
Add the words "and turnover" to the title after the word "breeding".;
add paragraph 3 as follows:
"3. Breeding and trafficking of domestic animals are carried out only if they are registered in accordance with this Law.";
11) paragraph 1 of Article 15 should be supplemented with sub-paragraphs 6) and 7) as follows:
"6) when regulating the number of stray animals (with the exception of cats) in accordance with the procedure and terms established by local representative bodies of the capital, regions, cities of republican significance;
7) in relation to neglected animals (with the exception of cats) admitted to animal shelters and (or) temporary detention facilities for animals that are sick, show unjustified aggression, are not equipped and are not in demand by the owner or responsible person, as well as other individuals and legal entities after the expiration of the time limits established by the Civil Code of the Republic of Kazakhstan.";
12) add paragraph 7 to article 22 as follows:
"7. The owner and (or) the responsible person who violated the requirements for walking pets, resulting in harm to human life or health, animals and property of individuals and (or) legal entities, are obliged to compensate for the damage caused in accordance with the procedure established by the legislation of the Republic of Kazakhstan.
In case of violation of the rules of keeping and walking pets, which has caused serious, moderate harm to human health, the owner of such an animal is obliged to euthanize in accordance with the procedure established by this Law.";
13) in article 23:
in paragraph 1:
in subparagraph 6), replace the words "by sterilization" with the words "in accordance with the procedure established by this Law,";
In subparagraph 7), the words "budgetary funds and others" should be deleted.;
in paragraph 2:
subparagraph 1) should be supplemented with the words ", as well as their accounting";
add subparagraph 2-1) to read as follows:
"2-1) euthanasia in the cases provided for in Article 15 of this Law;";
14) in article 25:
Paragraph 1 after the word "sterilization" should be supplemented with the words "euthanasia applied to cats in the cases provided for in Article 15 of this Law";
Paragraph 2 after the word "drugs" should be supplemented with the words ", except for the cases provided for by this Law".;
15) in article 26:
In paragraph 1, the words "rules of operation of animal shelters" should be replaced by the words "this Law";
in paragraph 5:
subparagraph 4) after the word "animals" add the words ", except for dogs,";
In subparagraph 5), the words ", including vaccination" should be deleted.;
16) paragraph 3 of Article 28 should be supplemented with the words ", in accordance with the procedure provided for by the Law of the Republic of Kazakhstan "On Public Control".
The footnote. Article 1 as amended by the Law of the Republic of Kazakhstan dated 06/19/2026 No. 317-VIII (effective from the date of its first official publication).
Article 2. This Law shall enter into force sixty calendar days after the date of its first official publication, with the exception of paragraphs two to seven of subparagraph 8) and subparagraph 10) of paragraph 3 of Article 1, which shall enter into force on January 1, 2027.
