1. The shareholder has the right:

1) to obtain the information specified in Article 22 of this Law;

2) to assign the rights of claim under the agreement on equity participation in housing construction in accordance with the procedure established by the civil legislation of the Republic of Kazakhstan;

3) require the proper fulfillment by the authorized company of the terms of the agreement on equity participation in housing construction.

4) require the developer to pay money as a result of the actual reduction of the acquired total area based on the results of a technical survey.

2. The shareholder is obliged to:

1) deposit money into the bank account of an authorized company in a non-cash manner in accordance with the agreement on equity participation in housing construction;

2) timely fulfill the terms of the agreement on shared participation in housing construction;

3) accept a share in an apartment building or a complex of individual residential buildings in the presence of a registered certificate of acceptance of an apartment building or a complex of individual residential buildings for operation within thirty calendar days from the date of receipt by the shareholder of a notification from an authorized company with the signing of a share transfer agreement;

4) in case of a change in the actual address and/or other personal data, notify the authorized company in writing within thirty calendar days.

This Law regulates public relations related to the activities of equity participation in the housing construction of multi-family residential buildings by attracting money from individuals and (or) legal entities, and also establishes guarantees for the protection of the rights and legitimate interests of the parties to the agreement on equity participation in housing construction.
