Enforcement proceedings are pending with a private bailiff of the Executive district of Astana, P. N.S. (hereinafter referred to as the CSI).23/21-71-160 dated 03/29/2021, initiated on the basis of the writ of execution of the Saryarkinsky District Court No. 2 of Astana 7117-18-00-1/155-10 dated July 09, 2023 on recovery from G.A. V. in favor of T. G.S. the amount of material damage is 9 500 000 tenge.  

In December 2016, T.G.S. applied to the Elite real estate company for the purchase of real estate, which offered to buy a 2-room apartment with G.A. located at the address: Astana, ul. T , 9, sq. 21.

Having concluded a preliminary purchase and sale agreement with a notary, T.G.S. handed over 9 500 000 tenge to the seller. With G.A., these funds had to be repaid by a collateral loan from Forte Bank JSC.

However, having seized the money from G.A., she subsequently refused to return the money and arrange the apartment, thereby committing fraudulent actions against T. G.S.

By the verdict of the court, the debtor and G.A. were found guilty and sentenced to imprisonment for a period of 5 years and 6 months in medium-security penal institutions.

To purchase this apartment, T. G.S. had to take out a consumer loan and repay the loan with an interest rate.

This dwelling is the only dwelling of T. G.S.

On 03.11.2023, T. G.S. and her family members were evicted from the specified apartment and they ended up on the street.

"The state is obliged to take all necessary measures to ensure that citizens do not find themselves homeless or vulnerable from the point of view of violations of other human rights as a result of eviction, regardless of its legality," said UN Special Rapporteur Raquel Rolnik, having studied the problems of forced eviction in Kazakhstan.

T.G.S. so much energy and effort, as well as funds, were spent to restore social justice.

On the basis of the above, I ask the court

To satisfy the submission of a private bailiff P. N.S. on foreclosure on property in the form of a 2-room apartment belonging to the debtor With G.A.

Appendix: a copy of the notice of the beginning of protection (representation);

              a copy of the power of attorney.
