complaint about illegal actions of police officers of the Isatai district Police Department of Atyrau region
On September 7, 2023, a traffic accident occurred on the Atyrau-Astrakhan highway opposite the village of Tuschykudyk involving a Toyota Highlander car driven by Tazhimurat Dzhumartovich Khudaibergenov, registration plates 7781KI Republic of Georgia, and a Toyota Ipsum car driven by S.S.B.
Subsequently, the officers of the Police Department of the Isatai district, without drawing up a protocol of suspension from driving and an act of seizure of the vehicle from the owner of the vehicle, Etc., installed the Toyota Highlander car in the parking lot of the Isatai district police Department.
Currently, the Tyulkubassky District Court of the Turkestan region is considering an administrative case against H. T.D. under art. 610 part 1 of the Administrative Code of the Republic of Kazakhstan.
The materials of the administrative case do not contain the above-mentioned procedural documents, as well as the decision to recognize the Toyota Highlander vehicle as material evidence and the decision to transfer the vehicle to the parking lot of the Isatai district police Department.
According to Article 26 of the Constitution of the Republic of Kazakhstan, no one can be deprived of their property, except by a court decision.
Currently, H. T.D. is unable to exercise the ownership rights to his property guaranteed to him by the Constitution, without any legal grounds, and is suffering property and moral damage. In the event of damage to his vehicle, it will be almost impossible to identify those responsible for causing the damage, since the staff of the Isataisky police Department actually relieved themselves of responsibility for the safety of the vehicle.
Based on the above, I ask:
- I ask you to check the facts of the arguments stated in the complaint.;
- recognize the illegal actions of the employees of the Isatai district police department and oblige them to transfer the Toyota Highlander vehicle to the owner of the plant.;
- to bring to disciplinary responsibility the guilty officials of the Isatai district Police Department of Atyrau region;
- to inform the head of the Atyrau region Police Department about the violation of the rule of law by the officers of the Isatai district Police Department of Atyrau region.
