Claim
The reason for my appeal is the unfair actions that were committed in my direction by your partners.
On January 29, 2024, P.K. LLP, represented by T.A.K., and myself, B.S.M., signed a service agreement No. 16, according to which they assumed obligations to provide advisory services in the form of group master classes at the G.KA school.
The above-mentioned relations correspond to Articles 151, 152 of the Civil Code of the Republic of Kazakhstan, which stipulate that transactions are made orally or in writing (simple or notarized).
Accordingly, a loan agreement was signed with JSC "KaspiBank" in installments to pay for the services of LLP "pk.
As of today, I have fulfilled my obligations to pay for services. However, LLP "P.Kazakhstan" is not fulfilling its obligations properly.
Violation of an obligation is understood as its non-fulfillment or improper fulfillment, which contradicts Article 349 of the Civil Code of the Republic of Kazakhstan, which is not permissible according to Article 272 of the Civil Code of the Republic of Kazakhstan.
Namely, the binding rules from Appendix No. 2 to the agreement with P.K. LLP:
"Registration for a lesson is mandatory because the number of students per lesson is limited" (paragraph 4);
"During lessons, you should not make noise, distract yourself and distract your friends from engaging in extraneous conversations, games and other matters unrelated to your studies" (paragraph 5);
"It is forbidden to play music loudly" (clause 7).
During the period of receiving school services, I noticed a violation of the above-mentioned rules: recording does not affect the number of participants in classes, which can be as many as possible or as few as possible, participants in "master classes" are not tuned to the learning process, and music is played in the school premises for random tastes, more often noisy-street or adolescent-depressive. You have to use headphones, which is self-isolation and prevents participation in the group.
In general, the creative creative process, for which this contract was actually concluded, is being damaged. On March 20 of this year, on this occasion, we have with the LLP "P. Kazakhstan" had a correspondence, and they promised to do something. I decided to give them more time and paid for the 2nd month of the contract, despite the moral losses I personally suffered, but it didn't get any better. Two experienced consultants have also dropped out, and there are more new students.
After some time away, I came to school on April 10, and found my current oil job on the floor, discarded from a tablet, stained with smeared paint. This happens for the third time in a row. The consultants said that it was kind of "normal" and could not inform how the work should be stored even after the fact. All this calls into question the quality of the services provided to me by the G.KA school. At the same time, I enrolled in a Moscow online school, where my work and abilities are adequately appreciated.
In addition, LLP "P.Kazakhstan" did not provide me with a check from the cash register, which is a gross violation of the Tax legislation of the Republic of Kazakhstan. According to this fact, they intend to file a complaint about violations of the law with the State Revenue Department.
In accordance with article 35 of the Law of the Republic of Kazakhstan "On Consumer Rights Protection", article 157 of the Code of Administrative Offences of the Republic of Kazakhstan provides for liability for the dissemination of deliberately false advertising.
In violation of the above-mentioned norm, "P Kazakhstan" LLP, without creating conditions for already recruited students, is replenished with new clients. On the social network Instagram, the profile of the school "G._.y" advertises their services, among which the first one is named "Education". But this is not the case. Recruiters are working online and on trial lessons, who are no longer responsible for anything. The "teachers", referred to in the contract as consultants, are not required to teach and situationally answer questions that arise, do not conduct any thematic lectures and conversations, you will not hear about artists and their paintings here. Each student cooks in his own soup – then what is the meaning of a group lesson is unclear. It seems that promises on social media and contractual obligations do not correspond to actual practice.
Today, Kaspi Market is the No. 1 brand of trust in Kazakhstan, and we trust your partners just like Kaspi, but unscrupulous service providers like P.Kazakhstan", abusing the authority of Kaspi Market causes irreparable damage to your image.
Based on the above, I ask you to take into account the violations described above by the service provider "P." LLP.Kazakhstan" and to assist in the return from the LLP "P.Kazakhstan" voluntary payment for the damage caused to me in the amount of 450,000 (four hundred and fifty thousand) tenge, minus the payment of the first month in the amount of 18,751 (eighteen thousand seven hundred and fifty-one) tenge, by April 30, 2024.
