on the resolution of the Specialized Interdistrict Court for Administrative Offenses of the city of Almaty dated December 19, 2023
On December 19, 2023, the Specialized Interdistrict Court for Administrative Offenses of the city of Almaty considered an administrative case against me under art. 73-2 of the Criminal Code of the Republic of Kazakhstan.
I believe that this resolution is illegal and unjustified on the following grounds.
The court's ruling is based only on the one-sided and biased testimony of the "victim" K.S. The court did not take into account my arguments, and found me guilty, despite the fact that apart from the testimony of the "victim" K.S. there is no other evidence that I caused him bodily harm.
According to Part 3 of Article 10 of the Code of the Republic of Kazakhstan on Administrative Offenses, "Any doubts about guilt are interpreted in favor of the person against whom an administrative offense case has been initiated. Doubts that arise when applying legislation on administrative offenses should also be resolved in his favor."
However, Judge K.D.M. considered that this requirement of the Law was not mandatory for him and, completely ignoring it, issued an illegal ruling on the case.
Based on the above, I ask:
- the decision of the Specialized Interdistrict Court for Administrative Offenses of Almaty dated December 19, 2023 to declare illegal and cancel.
